Hi to everyone. I just had a question about what to do when a local EQ affiliate is not picking up their certified mail. I sent 2 separate certified letters on 2/7 and one on the 2/21. They have not signed for them yet. I called their office before I sent the letter on 2/21 and left a message (you only have the option to leave a message at this place). A lady called me back several hours later and I asked her when they typically pick up their certified letters and she told me EVERYDAY. I am using the track and confirm option at usps.com and every letter I've sent to everyone else (which has been over 60 in the last 1 1/2 months including valid. letters, etc) has been received. I just don't know what to do. It is obvious that they are stalling, but I don't know what my options are. Also, they do not accept disputes (even an incorrect address dispute) over the phone. Everything has to be in writing. I could send it first class but I really don't want to send it any other way than certified. Any suggestions?

Send it to EQ HQ in Atlanta CRRR. It will get forwarded to the affiliate office. Plus it makes it harder to verify within the 30 day window.

Thanks dixidriftr. I did send my first letter to Atlanta and received a letter from Glen King saying that they forwarded my correspondence to the Memphis affiliate and further correspondence should be sent there too. Oh well, I will not waste anymore money sending cert. to my local anymore. Question>are they not allowed any additional time when they have to forward a dispute letter? Thank you again for helping me.

F.Y.I. if they don't pick up your CERTIFIED R/R you can get your money back from the POST OFFICE.

Thanks George...I did not know that. I may go ahead and get the money back then and use it to send the letters to Atlanta office.

They will start the 30 days from the day the affiliate receives the dispute, not when the main office receives it. You don't get any advantage to doing it that way unless you have problems like the one being discussed in this thread.

I sent an CMRRR to the Atlanta office (my local office) and they did not sign (however, I verified receipt on usps.com). They did delete the duplication stated in my letter and sent me a letter stating this and updated report. I have to send them another letter and I will see if this is their "norm" - not signing CMRRR.

Great info. Thanks. I thought about faxing this letter, but I'd like some input first.

    Dear Memphis Consumer Credit Association,

I sent two letters via Certified Mail to your location at 4066 Summer Ave. Memphis, TN 38122 on 2/7/03. As of this date, you have not signed for these letters. Also, another letter was sent to you from me on 2/19/03 and you have not signed for this letter. Please advise.

In addition, I disputed some inaccurate listings on my credit report on 1/13/03, sent to the Atlanta office, and received notice from Glen King that these disputes would be forwarded to your office. Please send to me the applicable section of the FCRA stating that you are allowed additional time beyond the 30 day period to reinvestigate these items as I am unable to find it.

Your quick response is greatly appreciated.

    Thank you for your time,

Is this okay to fax or do you guys/gals have anything to add/leave out?

Oops. I think I need to insert "as of 2/29/03 I have not received results of this investigation...please send me blah."

Because of the numerous replies to the letter I posted above (note sarcasm) I'm guessing I should forget about sending this. :) I suppose the best thing would be for me to just send everything to EQ's main address in Atlanta and forget about my local affiliate. Sorry if I've been annoying. :)

Update: Friday, 2/28, I faxed the letter I posted on here. Saturday, 1/1, I received a new copy of my credit report (dated 2/28) with updated results of my disputes. My first deletions! I almost fainted. (Couldn't have done it without reading this board constantly) Thanks to all of you. Am I naive to believe that my "letter" somehow got through to them? Probably so. It's ironic. They did not provide the dispute results within 45. much less 35. They still have not picked up their certified mail either.
