I faxed a dispute on Oct 2 to EQ in Atlanta. I recvd a letter from them on Oct 10 saying the dispute was sent to my local affiliate in Middleburg Hts, Ohio. Haven't heard a word since. I called them Nov 7 and the CSR said the never recvd it! Told her I have a MAILED letter from them that they did. She kept offering to start a NEW investigation. I kept telling her NO. After getting nowhere, I asked for supervisor. CSR finally came back and said OH WE FOUND IT NOW. She then tried to tell me that they have more than 30 days to respond...because of mail time! She estimates sometime around the end of this week, making it Nov 15. Is this correct?? Don't they HAVE to delete now since the 30 days are up and have been since Nov 2?? Even if they go by Oct 10, the 30 days are STILL up!! Can I sue them? Are they in violation?? Do they HAVE to delete?? Any info would be greatly appreciated!! mysti_summer
They do not have extra time due to mail. They have thirty days from the day they received the dispute...including weekends and holidays. There are FTC opinion letters on this (and I'm sure someone with better shortcuts than I have can post them for you.) I would send another fax to Equifax...the same fax number you sent your dispute to and tell them that the thirty days is up, please delete. Wouldn't even bother with ole CSC. L
She sent the disputes to Equifax when her area deals with an affiliate. It is 30 days from the time the affiliate receives the dispute, not the time Equifax did. If they received the disputes on the 10th, then the investigation should have been done on the 10th. They then have 5 days to notify of the results. So. if not received by the 15th, then start screaming.
