Not sure what to do... Disputed on 1/8 a whole bunch of stuff...including a 94 bk. I pulled a report a few days afterward to make sure all of my disputes were marked. All of them were except the disputed bk. After 30 days, I hadnt heard from them. Pulled my report to see if they completed all of my investigations. They did. Bk remained unchanged. Still havent received my report from eq, even though I did pull a copy online. I called to see if they had sent my results. They said, as always, that they did (buncha hooey). Anyways, I asked if they ever put my bk into dispute. She said there was nothing to dispute because they stay on for 10 years. I said that they never even marked it in dispute to begin with. She said they should have put a summary on the cover letter that it remains. I asked if they did that, according to the report they supposedly sent. She said she did not know. She coldn't see the info they sent me. Anyhow, I beleive one of two things happened: a) they never did the investigation, which then they would have to delete it; b) they decided it was frivolous and didn't have to do the investigation, in which, they would have to notify me within 5 days that they marked my dispute as frivilous Since the bk was never marked in dispute, as the others were, I don't belive they even investigated it. She asked me to send papers showing the discharge date (doesnt show it was ever discharged, but this is not why I disputed). I told her that CSC would have to do their investigation and part of that was contacting the court, so why should I send copies. The reason I disputed (its probably wrong) was that I read somewhere that dismissed or open ch7 bks could be reported for 10 years, but discharged ch7 bks could only be reported for 7. Anyhow, I beleive thye didn't even investigate when I disputed or that they took it upon themselves to mark it frivolous and didn't notify me of doing so. To this day, I still haven't received my results that were due on 2/7. They are in Houston so, mailing time, as proven by prior correspondence form them, is only 3 days tops. What, if anything, should I do next?
I had the EXACT same situation during CHOD. I had disputed 5 items--3 were noted as "in dispute." The other 2 were never marked. I called CSC. They swore they never got the letter requesting an investigation on these 2 accounts. The 2 accounts in question were listed on the same letter as the 3 they acknowledged. I called every 2-3 days and inquired until the 30 days was up. Each time I was asked "would you like me to begin an investigation for you?" Hell no! At about day 35 I got a report in the mail listing the outcome of the FIVE accounts that were under dispute. Wait a minute! The 2 never were shown as in dispute and their reps denied that they were on no less than 10 occasions. Interestingly, the date reported as verified was back in July 2002 on both of these accounts. The 3 they actually investigated were shown as 1/03. I know they did not do an investigation. I just haven't had time to write the letter and demand that they delete them. I bet they will with enough persistence. For your situation specifically, I dispute a bk on my husband's report from CSC. It did show "consumer disputes--reinvestigation in process" for the entire 30 days. It was deleted on day 30. Don't give up. I think you may have a winner! Lisa
Not sure what to do? compile my evidence and send it to them? The last time they didnt complete my investigation on time, I sent them a COPY of the original dispute. They marked everything on there as disputed as of the day they received the copy! I guess I can send them a little letter stating what happened and demand deletion. I will say that they already have my docs supporting they never did naything about it. Will not send anymore docs. Hate for them to put it into dispute now. Thanks Lisa

I kind of doubt that the deemed your request frivolous and didn't notify you. Experian, yes I could beleive that. I could believe it about TU too. CSC has never denied one of my disputes. I think they just screwed it up personally.
Just not sure what to do now. The lady I spoke with today was a little dusty upstairs. Im afraid if I write, they will think I am re-disputing again.
Just word the letter to make them very aware that you ARE NOT asking for an investigation. Your investigation was completed within the 30 day time frame without any resolution from them. You inspired me. I was thinking about my situation with those 2 accounts. I am going to write my letter today.
Thats great! I think I will do my letter tomorrow. I didnt know how far it will get or if they will just put it into the "round file". 1) they never marked it in dispute 2) I never revceived a notice it was frivolous 3) there was no info re: the investigation on the results I received (pending I EVER GET THOSE results, lol) I will wait until I receive their results, just in case there is a notation about the bk dispute on there. Then, if there isn't, I can say they never disputed it. If there is, I can say they never marked it disputed and labeled it frivolous without days notice. Hard to wait for the mail sometimes, lol. good luck and post your letter if you are comfortable. There are a couple of form letters that you can modify to make it easier. They tend to already have fcra statues quoted, etc. Think I will use my own, though.
Any updates on this? I'm having the same problem w/ EQ and am about to turn up the heat a bit. They continue to ignore my bk dispute letters, yet have never sent the "frivolous" notification at all, let alone within a five day window. The only thing I received was a letter (about 2-3 weeks after my second dispute) that said they will not answer "previously investigated" items without further documentation. They have also ignored my procedural request. I'm at my wit's end! Any suggestions?
Ha ha, yes... When I sent them the letter, they immediately covered up their mistake and put it into dispute. I called them to find out WTF because the first paragraph of my letter stated it was not a dispute...in BOLD letters. Well, the rep said that it was put into dispute and sounded puzzled when I told her I didnt do it. I asked what the reason for dispute was...she said it was a "not mine" dispute. I told her I sent a COMPLAINT letter and she said they must have though that it was a request for dispute. Total cover-up. Anyhow, now I'm so frustrated...they tried to cover up the fact they never did my investigation on this item by sticking it in dispute like it was just routine. I doubt I will get deletion for this now because I'm positive they will verify. GRRRRRR!!!!! Anyhow, results should be in later this week. IF they sned me my updated report (I always have a prob with this as well) I will let y'all know.
