EQ Deleting TL's In Masse!

    Nobody said deleting positive TL's were allowed by the FCRA. Continuing to report a positive TL is not made mandatory by the FCRA.

    Big diff.

    Please link me to the general fairness provision of the FCRA.

    You didn't read what I said nor check in the FCRA.

    The problem is with the furnisher, the tapes are good for nothing if the TL is being suppressed because it was disputed and then removed.

    The furnisher CAN have it resubmitted, but not by tape.

    The CRA's are required to keep items removed by dispute from appearing again.

    Lets put it this way.

    I got a letter from the OC that says, "Yes we did report it, and are continuing to".


    I demanded procedures and their reply was simply, and get this: "This account is currently not reporting on your credit report". LOL


    No Sh*t Sherlock, that's why I'm arguing with you about it.

    Remember this is an active ongoing account. When I disputed the lates I included copies of the other 2 reports, (TL only of course) along with copies of statements. They did NOT take into consideration the evidence I supplied.

    So now, Sassy, are you still saying I need to argue with OC?

    Belive me if I could get this fixed without syuing I'd love to. But I don't see another way.

    Yeah, your OC is furnishing monthly via tape, I say, that tape isn't worth what you are talking to sherlock about ;-).

    OC needs to do this:

    611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]

    5) Treatment of inaccurate or unverifiable information

    [bold]B) Requirements relating to reinsertion of previously deleted material. [/bold]

    (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate

    CRA's are doing this to you (same section):

    C) Procedures to prevent reappearance. A consumer reporting agency shall maintain reasonable procedures designed to prevent the reappearance in a consumer's file, and in consumer reports on the consumer, of information that is deleted pursuant to this paragraph (other than information that is reinserted in accordance with subparagraph (B)(i)).

    The TL ought NOT be suppressed. When I disputed it was because it showed lates on what I knew was a perfect account. Along with my dispute I send the evidence I mention above.

    They simply stamped it that the OC failed to respond so they suppressed the TL. I know damn good and well the OC did not fail to respond. Geez we're talking Cap 1 here. Not a mom and pop shop.

    The CRa didn't even contact the OC.

    Upon realizing that if the TL were rendered accurate it would be positive, therefore they figured out a way to delete it. They don't like me.

    It gets reported every month but doesn't show up. That means it's suppressed. But the fact that they suppressed it in the first place is why I'm peeved.

    AM I NOT EXPLAINING MYSELF RIGHT OR WHAT?

    Oh ok Sassy,

    Now all of a sudden they are complying with the law the way they're supposed to? lol

    I've been struggling with this since Sept. 02.


    Ok, so contact the OC, AGAIN, and tell them to send me a UDF?

    Tell me what YOU would try to do to get resolution.

    I see where our breakdown is. You're talking about the fact that since the TL is suppressed it wouldn't matter whether the OC reports again or not. It still would not reappear. Of course you're right Sassy.


    What I'm talking about is what happened BEFORE the TL was suppressed.

    They pretended to contact the OC and suppressed the TL, proclaiming the OC failed to respond. They did that because if they did correct the TL it would be positive. Baloni I say.


    • Failure to adequately contact the OC regarding my dispute. If they did, I find it impossible to believe that Cap 1 would "fail to respond".
    • Failure to take into consideration the evidence I provided. They are required to consider my documenation as accurate UNLESS they have good reason to believe it's not authentic.

    Well, you either have to get proof from the OC that they didn't really verify and create papertrail.

    Or lead the CRA's and create papertrail.

    Phoooooooooooey, with all that.

    Have OC recertify and resubmit the information like it was new (on paper UDF -- no tape). Then they'd have no reason to keep it supressed, well nothing to hang their hats on anyway.

    To get it reporting again I'd try reporting the card lost or stolen and get a new acct number.

    Catleg, that's a great idea, very creative.

    I thought of that too, but trouble is now you'd have a lost or stolen on your report, which also is not helpfull.

    No updates yet tho. Its' really become less important. But I WILL get em.

    Oh man!! Are you saying that having your credit card lost or stolen is considered derogatory?

    How in the world can that be an indicator of a greater credit risk?
