I disputed a FCNB charge off w/ wrong balance online w/EQ. For some reason I felt compelled to call EQ and spoke to a REP. I asked her thirty days are up and what is the status of my investigation? She said they have not responded so we changed the balance to $0. I said "if you cannot verify you must remove"...she said "No...we can't verify so we change it to $0". I said how do you know it's a $0 balance? That's inaccurate, you are doing this arbitrarily. She said well you stated PAID in FULL in your dispute, I said NO I stated Inaccurate Balance/Wrong Balance. Then she goes on to say well if you want it removed you have to redispute with a "NOT MINE". I said why would I do that? It's my account...it's just the wrong balance. Well she transfers me to a Supervisor, well she was curt and to the point...we're not removing the TL. I re-stated that she cannot verify so she must remove. She said we've changed to $0, I said no that's wrong. Furthermore, I told her that her REP suggested I commit fraud by stating it's not my account, she said she never said that, then I said I taped the conversation oh man did she freak out! One Party consent is legal in NJ and in GA. (I guess they'll just have to guess if I did record...I only wish I did). Basically, am I wrong that they have to remove this TL? Can I just redispute as "NOT MINE"?
i'm confused. would you rather have a tradeline w/an inaccurate balance (or $0 balance) or have it entirely removed? i'd rather have the tradeline. don't lie in your disputes. ask for reinvestigation due to inaccurate balance (why are you disputing it in the first place?)
sorry - missed the part about the charge off. no they don't have to remove it since you only disputed the balance - not the tradeline. (although TransUnion likes to to this) $1 or $1k - does the balance really matter w/a charge off?
they only delete the TL if it will hurt you more Here's what the FCRA says: A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall promptly delete that item of information from the consumer's file or modify that item of information, as appropriate, based on the results of the reinvestigation See, they do not have to delete.
