I had an OSI account deleted from Equifax and then it re-showed up a few weeks later (no change in information). I never received any notice of reinsertion. I called Equifax today and they told me that they did NOT have to send out a notice because it was the CA who told them to reinsert. This doesn't sound right to me. The one time I had an account reinserted on Experian - they sent me the required notice. By the way - OSI never validated the debt and it's nearly two months. They did report the account as in dispute - but never have I received validation. Is this also continued collection activity if they told Equifax to re-insert? (I still think Equifax is wrong here?) Send them a letter requesting them to remove the account or you will simply sue them in court. Apply for credit that you will be denied for and thus you have damages. They have to send you the notice within 5 days. I am going through the same crap. Also you can aske for the certificate of accuracy from the CRA. I would also notify the CA that you are getting real close to coming down on them as well. There is a link to some attorneys that are looking for cases like this. IMHO, that is a load of BS. That particular section of the law does not give the CRA any exemptions at all, much less one which is dependent upon who is reporting the information.
They gave me the same crap, and I have the conversation on tape, turns out the CA reported it under a different acct#, now two years later and now that is Equifaxs'defense. So I put the lawsuit against them on hold and am now going after the CA for reporting the account with a different account# to skirt around the re-insertion notice requirement.
I double-checked and it's all the same information as before it was deleted - same account number and everything. Even same date that they had updated before. And since it already was noted (by them) as in dispute - it wasn't that it suddenly showed up as reported as in dispute by them. This is a pure re-insertion - for which Equifax is denying any responsibility. I had this happen with Experian once - but they DID notify me. So I feel this is a violation by Equifax - and a violation by OSI since I did dispute it and they never validated. Mommy2cats
I am having the same problem. I disputed an OSI AT&T bill. EQ says that OSI did not respond in 30 days so they deleted since I disputed as not mine. Two weeks later it is back on the report. EQ says OSI respond and re-reported. No notice to me. It is in dispute again. They have done this with a Genesis Acct for me, yet I did not dispute the Genesis Acct, EQ took it off and then Boom 3 days later put it back. No notice or nothing. I call, EQ says you did not dispute it so, it does not matter. I am so sick of all the BS, what can we really do?!!!
Good (well not so good) that it isnt only me...I called equifax directly and they couldn't help me even though csc houston isnt taking phone calls. Took them about a month to reinsert.
