I have been fighting Equifax for two late pays that were reported incorrectly by Capital One. Everytime I dispute it comes back investigated and that it is being reported correclty. Capital One has told me they have sent a message to Equifax electronically three times. This has been going on for 3 months. I wasn't sure which side was jacking me arouind.

Finally this week Capital One faxed me a letter stating the derogs should be removed. I faxed it to Equifax at their request. Now they state that they wont accept the letter because it was on a non-standard form. But they would be happy to start another invetigation for me.

    Now I'm pissed. Any suggestions?

Both TU and EX fixed the probelm when I first noticed it.

you can use any damn form you want, and tell them that no where in the FCRA does it state that you must use their form. tell them if you have to use theirs, they have to use yours.

File complaint with your state AG, and with FTC.

And sue them in small claims court for willful non-compliance for knowingly reporting false information.

    Don't get discouraged!

I had my truck financer send me a copy of the Universal Data Form (which IS the proper form) to me which was sent to Experian who never corrected my account. I sent this to Experian who told me that "Unfortunately, we cannot use the documentation that you provided".

Hell! It was signed by the Vice president of the bank!!!

I understand that the UDF is what the CRAs use themselves.

Experian said " We will re-investigate". I'm ready for them if they do not respond.

Only the cheezy, crappy, un-verifiable info that the original creditor supplies is allowed!

    aaahhhhhhhhh!
