Has anyone had this situation? I am pulling all of my paper trail together now for my letter to EQF (CSC). During CHOD I disputed 4 accounts with them via letter CRRR. A week later 2 of the 4 accounts were shows as "in dispute" on Credit Watch. The other 2 were not. I called CSC. The rep told me that they had not received a dispute on these 2 accts. I explained that they had received it because it was on the same 1 page letter as the 2 accts that they had under dispute now. The rep blew me off and told me to check back in a week or so. Throughout the 30 days I pulled 10 separate reports on CW. They never showed the 2 accts as in dispute. At about day 28, CSC sent me an updated copy of my report listing all FOUR of the accounts I had in my letter. The verified dates of the 2 that were never shown as in dispute were 6 months prior to this supposed investigation. The 2 that had shown as in dispute both showed verified dates of 12/02 as you would expect. Am I completely missing something or is their 30 days up on this? My letter basically explains what I said above. I included copies of my original letter, green card, and excerpts from the 10 reports that did not show the accounts in dispute. Does anyone think they will delete these based on this?
Hi Lisa, THE SAME THING happened to me. I pulled a copy after dispute was sent to make sure everything was marked. I disputed a bk and 6 other items. The 6 were marked, but the bk wasnt. I figure 1 of 2 things happened: either they got the dispute and didnt do this 1 and did the others, in which case they would have to delete or they deemed it frivolous and never bothered to investgate. FCRA says they must notify you within 5 days. They never did. Since they never marked it in dispute, they cant say that they deemed it frivolous on the 30th day. I got the same runaround from the rep. First they said they didnt get it, blah blah blah.They completed their investigation and 2 weeks later I called because I hadnt received anything at all. They said they were mailed out the beginning of feb and to just wait. Well, I check mail yesterday and the results were postmarked the 18th...well after when they said they mailed them. Anyhow, on their letter they listed the bk as "remains". BS!!! The rep even told me the investigation was not done because they didnt have to. This was after she told me they didnt receive the request. Then she tells me to sent a copy of the bk. I say "Its YOUR job to investigate...call the court." So, I call bs on their little game. I will email you my letter if you like. Let me know what happens.
So Nik, are you basically demanding deletion like I am? The reasoning being that their 30 days is up, they never deemed it frivolous, and they never bothered to investigate it. I also asked at one point during the 30 days about the frivolous issue. I asked the rep if that could have been the case. It was near the end of the 30 days, and I wanted to know where I stood. He said "no, if it is deemed frivolous a letter would go out. Our system would show that correspondence was generated beside the account." He went on to say once again that they never got it.
I got your letter. I like it. It is well written and not hot headed. You sound like you know your rights. Good luck to you. Come back to this thread and let me know what happens. I will do the same. I am off to the PO to mail mine CRRR now. I have a very similar situation with Experian right now. During CHOD I sent them a list of 4 disputes (on 1 letter again). They put 3 under investigation. For the 4th item they sent me a letter and said "we can't find the account on your report." It was there! Exactly as I had written it, and exactly as they had written it in their letter. I think it was just a screw up on their part. I think I am going to try the same tactic on them. Do you think it is the same thing?
Sounds like EX may have made an honest mistake. BUT, CSC, at least I dont beleive it, did not investigate on purpose because they may have felt they didnt have to. Not sure what will happen. Im gonna give em hell, though, lol.
