I had an unpermissable Amex account which I had American Express delete today. I think because of this I had unpermissable hard inquiries on my Equifax credit report for the past year and a half. American Express has stated me to write to Equifax to have them delete these inquiries. What kind of letter should I send them, how long should I wait, how should I mail it (e.g., Certified, Return Receipt, etc...), where should I mail it for Equifax and Experian. Any help would be much appreciated in advance. -Gavenraj
Others may have a different response, but I have tried to dispute inqueries with all the CRA's and the response from them is you are on your own. The CRA's will provide you a list of address, etc of all the companies putting a inquery on your file and you have to send a letter to them asking them to prove you gave them permission to pull a report. Most of the time the letter is ignored or they do not have proof. So far I have sent 8 letters out have gotten 1 response and the letter I received did give permission to delete, however they are basing it on fraud. I don't want to send anything like that to the CRA and start a whole fraud alert thing so I let that dog sleep.
gavenraj, Equifax will not remove just cause you write to them.. Tell Amex it was there non permissable inquiry and they need to get it deleted not you... And if Amex doesnt i believe thats a 1,000 violation...

Amex stated that they cannot do anything and said I need to write a letter to Equifax and Experian about this. What kind of B***S*** is this?

When you dispute with the CRA they always tell you that is a "FACT" that your report was pulled by the creditor therefore they cannt delete it, even the law said so.. anyway..this is what I did on 3 creditor. Send a letter demand for $1K on each violation or you will sue, dont waste your time with the customer serv reps, they dont care & dont know what you're talking about, send the letter to the CEO, CFO, COO etc etc, then days later the legal department will respond right away, and help you delete it in 24 hours.

Records shows that your company access my file on or about 01/2002. I do not recall applying for credit, employment or insurance with your company on this date. From the FCRA ?616. Civil liability for willful noncompliance [15 U.S.C. 1681n] "(b) civil liability for knowing noncompliance. Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or $1,000, whichever is greater." From the 1998 FTC opinion letter Greenblatt at http://www.ftc.gov/os/statutes/fcra/greenblt.htm "Any person who procures a consumer report under false pretenses, or knowingly without a permissible purpose, is liable for $1000 or actual damages (whichever is greater) to both the consumer and to the consumer reporting agency from which the report is procured." Your company has been advice about this unauthorized inquiry since June 2002. Numer of letters and faxes were send but you have fail to respond. Please have this inquiry removed immediately. At such time as the inquiry is removed, kindly send me such documentation for my records. Your failure to acknowledge or respond to this letter within 5 days or by July 05, 2002 will be interpreted as your authorization / instruction for Experian to delete this inquiry. At that time please arrange for payment in the amount of $1,000 for eachof your violation. I will also take leagal action against your company for further damages and time wasted in this matter. In addition, a formal complain will be file to FTC, BBB and state attorney general for your willful noncompliance.
