Equifax deleted wrong account

    Hi all,

    I just received back my second round of disputes and the Equifax one or CSC here in Texas deleted the wrong account. My husband had two First Premeir accounts on there that I disputed. They deleted one of them and also deleted his First State Bank account , which by the way is a good account, instead of the other First Premeir account. My question is what do I do to have them correct it do I call them or fax them a letter along with the copy of the original dispute telling them about their error. Is it really going to make that much difference in my husbands scores it was an old account but it was also a good one where as they left the bad account on there. Thanks for any advice.

    Why is it that anytime I post on this forum no one replys or helps me. I think this is a great forum with lots of information so I don't understand why no one ever bothers to answer my questions! Am I on a black list or something?

    Sorry this isn't a reply to the specific question you asked.

    But I'm not an expert either and I would sometimes post a message here that gets no replies.

    I would try posting this message on other forums like www.cardreport.com (they have a message board there too), and also www.bayhouse.com (another good message board)

    I bet you'll get some kinda of answer from at least one of these. Or do a search on either of those boards... I bet the issue you described may have come up in past postings. Good luck.

    bayhouse is kinda cool but nobody hardly uses it or posts a reply. It could be that nobody simple knows the answer. I think we all go to bayhouse to enjoy the cash that christine won against wells fargo.

    Hi guys,

    Thanks for the resposes even though I didn't get an answer to my questions. I also post on Bayhouse and Christine usually answers but lately she hasn't been so I guess maybe she took a vacation or something which she desperately needed but I find it hard to beleive that no one on here has gotten a bankruptcy or tax lein deleted or had Equifax delete the wrong account. I don't post alot of responses because I am new to this and don't have enough experience yet to help anyone, but I know there are alot of people on here with lots of knowledge and experience with all of this to give some of us newbies some advice and guidance. Thanks again for your replys.

    Hi,

    I'm sorry I can't specifically answer your original question about the deleted accounts, but I wanted to address your feelings about your questions not being answered.

    Remember, not everyone that is on the board at the time that you post your question can answer it.

    I try to answer as many questions as I can, but I can only answer questions that I have had experience with, or that I know the answer to.

    The board is busy sometimes, and sometimes it is just a couple of posters.

    So no, you are not being blacklisted, or ignored, it is just that noone can answer your question at that time. :)

    Hey, think about it, do you want uninformed people answering your posts? ;)

    Remember you can bump your post to keep it at the top.

    Don't get discouraged, there are very helpful people here :)

    You did make the first step and found this board.

    Searching is very helpful also.

    I know this is a very long post, but I just didn't want you to get discouraged.

    I would recommend calling Equifax and tell them that you disputed an account and they deleted the incorrect one. Just ask them the steps that can be taken to correct this problem. Let them know you have copies of the original dispute and that you can fax them copies if need be.

    just call the original creditor and tell them.. They will report again and when equifax gets the tape it will be back on your report..

    Okay,

    I called CSC who handles Equifaxes disputes here in Texas and they said that my husband would have to call the original creditor to reinstate the item they took off even though they were the ones in error. The problem is that the account was reported wrong to begin with and shouldn't have been a good standing account. So I guess I will just leave it alone. As far as the actual account I disputed they said I would have to dispute that Item again. She also said I would have to send in a copy of my husbands drivers liscense with the dispute. Is this because I was questioning his account and not Him? I have never sent in I.D. before. If anyone else has any suggestions or experiences please help. Thanks again for the people who did respond.

    I don't think so.

    Do you have proof of what you originally disputed? (like the confirmation page you print when disputing online?)

    If you do, mail CRRR or fax EQ it and tell them they need to delete NOW. It's been 30 days, and that's all they get (unless you provided additional information which you haven't).

    They do not get to choose which account(s) to dispute and which not to. You disputed an account, they screwed up, as usual, they had their 30 days to do their so called investigation, they failed to follow the FCRA, and now they expect you to re-dispute it?

    Like I said, I don't think so.

    I have the original dispute letter. I faxed it but I have the confirmation from the fax machine that it went through. So do I send copies of the original dispute and demand they remove it? Do I send to CSC again? I guess I should have caught this as a violation it just didn't click. It has been a long day. Thanks for catching it mindcrime. Please let me know if this is the correct action to take. Still new at this.

    Yes, I suggest you send copies of the original dispute letter along with a copy of the fax confirmation sheet. Might be a good idea to mail them CRRR. You don't want them playing games claiming they never received this (new) fax. As far as sending it to CSC, I suppose you would have to. I know in certain areas your file is handled by the affliate instead of the national CRA office.

    FCRA:

    § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]

    (a) Reinvestigations of disputed information.

    (1) Reinvestigation required.

    (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer.

    They had their 30 days to reinvestigate. According to CSC, from what you're saying, they could just use "oh we investigated this other account" excuse just to get out of having to delete the true account that was to be investigated.

    Send the original dispute letter, the fax confirmation, a new letter demanding deletion, and include section 611 of the FCRA for them. Apparently, they forgot to follow the law, again.

    Hey,

    Mindcrime or anyone else. I have some other items that need taken off of this report. Is this enough of a violation to sue them to delete everything or am I just jumping the gun. Would I need more than just this violation to have some weight with them? Just wondering still new to this. Might be getting in over my head.
