Hi everyone, I have a situation where equifax has been sitting on several of my disputes since way back in 7/1/2002 They have just been sitting there stating "consumer disputes, reinvestigation in process" for all that time WTF? I do additionally have some newer items I placed under dispute around the 10th of last month. What would you do in this situation?.....wait untill these newer disputes sit there for over 45 days or just yell at them now about the older disputes that were sitting there forever. Thanks, Sal
If it was me, I would have started screaming about August 10th. Why have you waited so long to ask? Wow, I would call first thing in the morning, get a supervisor and have him/her delete them on the spot. They have not notified you within 5 days of the end of the 30 day dispute period. § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i] (a) Reinvestigations of disputed information. (1) Reinvestigation required. (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer. (B) Extension of period to reinvestigate. Except as provided in subparagraph (C), the 30-day period described in subparagraph (A) may be extended for not more than 15 additional days if the consumer reporting agency receives information from the consumer during that 30-day period that is relevant to the reinvestigation. 5) Treatment of inaccurate or unverifiable information. (A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall promptly delete that item of information from the consumer's file or modify that item of information, as appropriate, based on the results of the reinvestigation. (6) Notice of results of reinvestigation. (A) In general. A consumer reporting agency shall provide written notice to a consumer of the results of a reinvestigation under this subsection not later than 5 business days after the completion of the reinvestigation, by mail or, if authorized by the consumer for that purpose, by other means available to the agency. (B) Contents. As part of, or in addition to, the notice under subparagraph (A), a consumer reporting agency shall provide to a consumer in writing before the expiration of the 5-day period referred to in subparagraph (A) (i) a statement that the reinvestigation is completed; (ii) a consumer report that is based upon the consumer's file as that file is revised as a result of the reinvestigation; (iii) a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available; (iv) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the information; and (v) a notice that the consumer has the right to request under subsection (d) that the consumer reporting agency furnish notifications under that subsection. In my opinion, if tomorrow they refuse to delete, you have the perfect oportunity to file a lawsuit and offer to dismiss if they delete EVERYTHING negative.
LKH, I appreciate the response. Well I just wanted to give them some time to finish the disputes, but in retrospect I might have been too kind. Anyway I have some newer disputes that arent due to finish investigation until the middle of this month -do you think they may try to screw me over on these newer (very important) disputes if I yell at them about the older ones? thanks, Sal
Will they mess with you if you yell to loud? Maybe. Is the middle of the month the 10th or 12th, or 18th or 20th? The reason I ask, is if it's just a week til the results are due, then wait. If it isn't til towards the end of the month, then I'd consider calling tomorrow.
LKH, According to the Credit Watch online dispute webpage it states I have TWO dispute resolution dates, of which both are 09/18/2002. Is it just my imagination or is equifax jacking me around? where are the disputes from 2 months ago? -Sal
Well, it's up to you. If you are pissed enough about it, call them. If not, wait the 10 days and see what happens. If on the 18th, your disputes from July are not deleted, you can call and ask them when they were verified. If they give you the dates, and they are way past when they should have been verified, you can then send a demand letter that they delete what you disputed since they took xx days more than the law allows.

One more thing Sal, I don't know if you disputed online or by certified, but if certified, I assume you have the green card showing the date signed for? If online, did you print out the page that shows confirmation that they received your dispute in July? I hope so. You should also today go back to equifax and print out the page that shows it still in dispute. That way, if necessary, you have all the proof you need that they received it on July 5 and as of Sept 8 it is still not complete.
LKH- I am having the same problem. I didn't send it CRRR or inline. I did notice that on my inquiry section that they pulled a "consumer reinvestigation". Would this be sufficient evidence that they recieved my dispute? It is on there seven days after I sent my dispute.
You got me on that one. I have never seen or heard of them putting that in the inquiry section, although it makes sense since the timeline is right. Is it evidence? Good question. Do any of the disputed accts show as being disputed?
No, none of the accounts are shown as disputed. They never mark them that way. I have disputed these tradelines 6 times. However, I called the lady back again(4th) time, she said she had been out of the office all last week, but I had talked to here just a few days prior? She did say today that it would be deleted and I would recieve the results in days. We'll see... I did look back at all my reports and it seems that everytime I dispute, there is a CSC consumer reinvestigation to match. I bet this would work for evidence. CRRR from now on.
