equifax lawsuit?

    Hi everyone ... have not been around in awhile (was taking a break).

    I had a collection from AFNI on all 3 of my reports. i got afni to delete in november. all 3 CRAs deleted, but about 2 weeks later, equifax added it back. i called equifax to find out why they added it back, and they said it was never deleted, even though i have credit repots showing that it is not on there.

    i called AFNI. they said they didn't tell equifax to put it back. my contact there called equifax and told them to remove it again. i also filed another dispute and sent them the letter from AFNI stating that the account was to be deleted. in deceember, equifax sends me a letter saying they investigated the account and their results were to delete it. in that SAME report, however, IT WAS STILL LISTED! how stupid and incompetent can you be?

    i applied to refinance my car loan and was denied due to collection on report. i was denied a credit card, and i got quoted a crappy interest rate for a loan due to collection. the damages are mounting.

    i called equifax last week. they said that i needed to buy another report to speak to anyone there about this because the dec. 5 report wasm ore than 60 days old so that confirmation number was no longer valid. i said, wait a minute because of your incompntency, i have something on my report that even YOUR company agrees shouldn't be there, and now you want me to buy another report to talk to someone about it?!?!?!?! "well sir, things don't just appear on your report like you claim they did."

    so i called AFNI again and my same contact was flabbergasted. she couldn't understand why they won't delete. she called and they told her that they would delete. it's still there.

    i have had enough of these shenanigans. i think i have sufficent damages at this point. what do you all think? should I sue? and where should i send this lawsuit to? every time i call and ask for the legal department, they say they can't give me that number!

    i also filed complaints with the FTC, the BBB, and the GA State Commerce. i really can't believe they tried to make me pruchase another report!

    What are the time frames for this stuff Tboy?


    Looks like a lawsuit's right around the corner.

    If you were turned down within the last 60 days you can get a report free.

    In November 10 AFNI closed the account and a deletion request was sent to all 3 CRAs. It was removed from Equifax then. I bought car on Nov 16 and it was still not on the Equifax report. The day before Thanksgiving is when I saw it back on my report. I have a subscript. with Privacy Guard. I called AFNI the day after Thanks. and she contacted Equifax for me the next week. I then contacted Equifax myself that next week and they told me that it had never been removed and I requested they re-investigate. AFNI also told me that Equifax told them they would remove. On Dec. 5, 2003, Equifax sent me correpsondence saying they investigated and they were deleting. They inckuded with that an updated copy of my credit report, dated Dec. 5 as well, and it was STILL THERE (sigh).

    I called Equifax last Friday, April 2 and AFNI same day. AFNI called Equifax same day. I checked Privacy Guard today and it's still on my report. I applied for the credit card in Feb. the mortgages in March and the car refinancing April 2.

    It's so aggravating. If i could just talk to someone there, maybe I could get this straightened out. But they won't let you speak to anyone with any real authority.

    What do you think I should do next?

    ps you can't get an online report for free -- even if yoiu were denied credit -- with equifax. you can only order one to be delivered to your house. you have to pay $9 if you want to view it online.

    I have a script to PrivacyGuard, which is how I can see my reports. I can't believe they make people buy their reports from them before they can speak to anyone about a mistake.

    does anyone have any phone numbers or emails for people (who have authority and who care if they get sued) I can contact at Equifax?

    Sure. She is Equifax Consumer Relations Specialist,
    Office of Consumer Affairs. She is definitely a "go to" person who makes things happen.

    I am still considering suing them -- not cause of the money, but because they actually have caused me damage at this point. and they shouldn't be making peopel buy credit reports just to dispute something that they themselves admitted should be deleted!

    How many reports have you requested/rec'd?
    GA requires the CRAs to give you 2 Free per year-
    Doesn't matter if you have been denied credit.

    If they have refused- you can notify the State & they will file charges against the CRA for violating state law
