EQuifax Mistakes

    Okay, I disputed a collection account with EQ and they verified it. problem is I have a Letter from the ca saying that they no longer have the account and would notify all three cra's.

    what should i do

    1) send EQ a procedure request?

    2) Send intent to Sue letter to EQ

    3) File lawsuit and skip steps 1 and 2

    Please help, I really wasn't expecting this one (LOL)

    What date did Eq supposedly verify the account? When did the CA 'lose' the account? I have the same problem with Eq and it's being handled via my lawsuit. ONE of the reasons for suing them. They supposedly verified 3 accounts (same CA). I sent a validation letter to the CA, they replied with a letter stating that they hadn't owned the account in 8 months and had notifed Eq to delete it the last 2 times they sent them a consumer dispute form.

    Equifax kept saying it was verified. The CA sent me a copy of the CDF and it in fact said "delete, we don't own the account".

    I would sue Eq if you can get the proof together. You dont' have to request procedure if you can get your own information.

    Thanks for the reply.

    Equifax verified the account 2/02. Just received my copy of the updated report today! collection agency lost the account in November 2001. I have the letter they sent me, but no copy of UDF. So should I file now, or try to get copy of UDF first.

    It depends on what you want to do......

    If you just want the account deleted then send EQ a copy of the letter you have and demand removal.

    OR.......

    If you want to sue EQ, then see if you can get a copy of the UDF from the CA. In the mean time I would request the procedures used to verify the account with EQ. That way you have solid proof to file a lawsuit if you choose to.
