I had a Chapter 13 Bankruptcy that was dismissed in 1999. I filed it in February of 1997. When will it come off of my credit report? I pulled the information below off of the Equifax website. It doesn't say how long dismissed chapter 13's stay on your report... How long does information remain on my credit file? Credit Accounts Accounts paid as agreed remain for up to 10 years. Accounts not paid as agreed remain for 7 years. Collection Accounts Remain for 7 years. The time periods listed above are measured from the date in your credit file shown in the DATE OF LAST ACTIVITY field accompanying the particular credit or collection account. Courthouse Records Remain for 7 years from date filed except: Bankruptcy-Chapters 7 & 11 remain 10 years from DATE FILED Bankruptcy-Chapter 13 non-dismissed or open remain 10 years from DATE FILED Unpaid Tax Liens remain INDEFINITELY Paid Tax Liens remain up to 7 years from the DATE RELEASED
Equifax says a "non-dismissed or open ch13" will remain for 10 years from the date of filing. But I can tell you from personal experience that their unwritten policy is to also include "dismissed ch13" for a full 10 years from the date of filing. I have been trying in vain to have my voluntarily dismissed ch13 (from 1995) deleted, and they refuse. That is so unfair. The good news is, if you filed in 1997, you should not see the entry listed on TU or Experian, as they usually delete any ch13 7 years from the date of filing.
Any chance you verified for them while disputing this? For instance, did you say "this bankruptcy was dismissed" - if you did that you will never get it off, you verified it for them. That is the debate going on in the other thread. It leaves you folks with dismissed bk's out in the cold, because you cannot get the accounts "included" in a dismissed bk.
