Equifax started its own investigation!!!! This is a first for me!!

    Ok...either I did something really good or really bad.

    RE: my current posting on Equifax not knowing DV laws...

    I did obviously communicate SOMETHING to Equifax that got them stirred up. I just checked on the status of my investigation and much to my surprise Equifax started one of their own. Coincidence...I think NOT!! I told them I was going to file suit against them if they didn't delete the account in question because they didn't know the FCRA or FACTA laws ( I was really peeved, I said SOMETHING to that effect). Maybe just MAYBE this worked. Not only is it an investigation, but it was started today (21st of June) and is expected to be completed on the 23rd!!! Yes, two day investigation. Has this ever happened to anyone else??? What does this mean? Please tell me this is a GOOD thing.....PLEASE! This is all I need to be clean of any negs.. and my house closing can be a peaceful good rated one. This credit stuff is a roller coaster ride...UP and DOWN and UP and DOWN and THEN SOME!!

    Maybe they are complying with the requirement to "reinvestigate" under FCRA. That is supposed to put additional obligations on them to insure correctness, while giving you the right to request the details of how they verified, and who they contacted.

    What was the nature of the credit file information you were disputing?

    This is the medical acct. I was referring to. The last neg. on my file. I have never known a CRA to open up a new investigation on its own...and def. not one that is completed in two days. I think they re-read the dispute, saw that I had given them a tracking # for the CMRR to the CA and now know that the CA had to legal right to verify the debt while in DV status. And, I hope that this means a deletion. I can keep my fingers and toes crossed anyway. I have been at this all day. It's almost 5:00 a.m. AZ time and most of you all are getting up and about for work. I'm gong to bed. I will catch up with al of you on the board later.....

    If you complained, and threatened to file suit, that is an act of "dispute". The CRA must legally "reinvestigate" the dispute. Though you may not have disputed through a more traditional channel of on-line or written dispute; your verbal communication via telephone is still "evidence" of disputing accuracy of a tradeline on your CR. This act would fall under the "prudent man" theory used in courts often, that being what action would a "prudent person" take under such circumstances? In your case, it would be a reinvestigation of your dispute.

    Also, there may have been something not 100% compliant in the previous investigation. Equifax does want to cover themselves, hence the urgency of opening another investigation.

    Ok. agreed. I asked for a re-invest. but why did it only take them two days? and why does Equifax now have no record of it? I was out of town and couldn't save the doc. I am so ticked. I have no proof and they say it never happend. Screwed again!!
