Equifax/unknown lates/Can of worms?

    I recently disputed three unknown lates that were added to my husbands credit report after a dispute.

    They are listed as 1 ,30 day late and 1 ,60 day late.No specific dates are listed.

    The problem is that my husband does not remember those lates, it was over a year and a half ago and the dispute came back as " Equifax has reported this account correctly". But there was still no confirmation of the dates. They simply gave me the address of the originial creditor to dispute directly with them. Is that MY job? Are they not supposed to document actual dates to go along with lates?

    Is it worth it to press this any further? Do unknown lates impact a score? Thanks Diane143

    Yes, unknown lates do indeed impact your score, because if there is no date, the computer looks at it as a recent derog.

    The CRAs are required to report information which is both accurate and complete. If they are not reporting the date, then it is not complete information.

    § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]

    (a) Reinvestigations of disputed information.

    (1) Reinvestigation required.

    (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer.


    (5) Treatment of inaccurate or unverifiable information.

    (A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall promptly delete that item of information from the consumer's file or modify that item of information, as appropriate, based on the results of the reinvestigation.

    Would you mind posting your letter here about the "unknowns" I have one account that I disputed as never late (said late 39 times - was a 14 year mortgage) and then it came back as verified and they ADDED 3 60 days lates. When I went in and looked it has 36 dates unknown at 30 days and 3 unknowns for 60 days.

    I did call EQ about it and her response was that the computer show all the dates. I told her not my problem but no luck so any help drafting a letter would be appreciated!

    Here is the letter I used, short, smart and straight to the point.


    Dear Equifax Credit Info Services:

    I am writing to dispute the accuracy of my credit file. Currently you are reporting (X) items on my credit file which are incomplete. Please verify the accuracy of these accounts and update my credit file. If the information reported cannot be verified or reported accurately, please remove it immediately.

    The accounts in dispute concerning accuracy are:
    XXXXX
    YYYYY
    ZZZZZ

    Each of these accounts contain unknown dates concerning payment history. These unknown dates represent a negative impact on my credit score per your Fico report based on my credit file.

    I have attached documents clarifying the specific areas of dispute. Please correct these tradelines as to maintain accuracy and completeness as prescribed under the FCRA.

    I thank you for your assistance and cooperation and correcting these matters and look forward to hearing from you.

    No problem but you may have to wait a few days. I think I got some kind of food poisoning and ckecking my mail is all the energy I have right now. You letter sounds good though.

    BTW-Did you ask the Equifax person what the dates were if they were listed on the computer?
