My wife to be has an issue of her ex's bad credit bringing her score way down...we have divorce paper work stating the ex is soley responsible for the bill not being paid now in collections....i need an address to the three credit entities to write and send them a copy of the papers to get her situation fixed. Also collectons keep calling threatning to take us to court any ideas to get them off our back?
Well... check the stickies at the top for the addresses for the three CRAs... and as for the phone calls... if you tell them they have to communicate with you in writing and cease calling, they have to. Search a little on this site and you'll find exactly what to tell them. Good luck.
Unfortunately, just because the divorce papers say he is responsible does not make it so. If the lender won't remove her name (and they probably won't), then she is still liable for the debt as well. She could pay it and sue him for the amount, showing that he was to pay it, but the creditor does not have to honor the divorce decree. Just because he is responsible for paying it does not remove her from the account. I was awarded the house I live in, and the divorce decree stipulated that I was responsible for the mortgage. But his name was still there, and didn't come off the mortgage until I refinanced. If I had defaulted, he would have been stuck. The creditor can sue her and even get a judgment against her. As I said, her only recourse is to pay it and sue him for the amount.
