a CA violated the C&D letter that was sent by CMRRR by calling repeated times. there is no tape recording what other evidence could be used in this senerio to prove the violations? would the court consider a witness testimony as acceptable proof?

Ice thx just read the link, I did have a witness which helps and I took an actual picture of the display on my caller id lol sounds crazy but I hope it works it shoes their actual name and # in this case would you recommend sending them an ITS letter first requesting settlement or just file and let them negotiate at that point?
ice lol full on water snort huh. the picture was actually from the second call the witness was there for both calls. so I guess I will prowl around a bit wait for another call or two then pounce on em and serve them with suit. can anybody answer the question about what an AMA report is with the phone co? Well how do you actually prove that they received a CD letter. You do have a green card, but what if they argue that what you sent them was not a C&D.... Even if you add a tracking number on a C&D letter, how can you PROVE that you actually sent them a C&D letter, not a blank paper for example...

Re: Re: evidence against C&D calls ****************************************** I do have a green card and a copy of the letter I sent to them that actually shows the tracking # on it, I can use that as evidence to show that the CA actually recieved that document by CM . the document I sent was a request for validation and contained a partial C&D stating that all communication was to be in writing only, since the CA responded to my request for validation it would be obvious they recieved that letter . if that wasn't enough I have a witness who heard the entire coneversation on speaker phone where the CA admits knowing that they were to contact me only in writing but they are trying to shift blame to a rep saying that he was not fully aware supposably not to call me as their were no notes in the computer. well ya know what I say thats NOT my problem its yours, as LBROWN would say PAY ATTENTION !!! the way I see the CA had full knowledge of those facts and disregarded my request anyway and now they are trying to cover their butts by making excuses which in my book does not hold water.

Re: Re: evidence against C&D calls In response to your question about cell phone devises maybe some more sophisticated consumers can assist here. I do remember a hands free device that is offered while driving your vehicle it is set up through your cars stereo system like a speaker so if you had a portabale tape cassette player you may be able to record that way, but as far as being out of the vehicle you should check with your provider to see what options are available or try the internet google search. sorry I couldn't be of more help.
