Has anyone read Experian's "Ask Max" online credit advice column? Out of curiousity, I was searching the Experian online advice column "Ask Max". I looked up some information on how Experian purges charged off accounts. The column basically regurgitated what the FCRA states. The difference is when you speak with EX representatives on the telephone, they are completely clueless and tell you something completely different than what the FCRA states, as well as their own company's credit advice. For instance, I have been trying to get Experian to report the dates that led to an Exxon charge off dispute. I have spoken with numerous EX telephone representatives and they all insist that creditors do not have to report the delinquency dates. I have quoted the FCRA and sent copies of the FCRA to Experian regarding this matter. However, nothing changed. It was always verified as reporting correctly, minus the required delinquency dates. However, Experian's Ask Max online advice states that the FCRA requires all creditors that report chargeoffs must provide the CRA with the delinquency dates that led to the charge off. Another issue is the date in which Experian uses to determine the purge date. Experian has stated over and over again that they use the charge off date as the official purge date of the account or the day the account went delinquent at 180 days. However, Ask Max states that 'Experian could wait 180 days, about six months, after the first missed payment is reported before beginning the seven year period. But Experian doesn't make you wait an extra six months. We begin counting the seven year period from the first missed payment that led to the charge off." My interpretation of this is Experian is suppose to calculate the purge date based on the date an account first went delinquent at 30 days that led to the charge off. I know that this information is not knew. But, what makes me excited is that this credit advice came directly from Experian, and their telephone representatives are clueless about aware of their teachings via Ask Max. I intend to send Experian copies of their own advice and insist that they take the necessary steps to obtain the missing information. What are your thoughts on this issue.
They will probably cite that this is their company policy! According to the FCRA, they cannot report a tax lien 7 years after date of payment. Even though I proved (from the state dept of revenue) that payment was made 5/15/95, they cite that their policy is to use the date of release. In my case, a screw up delayed the release until 7/2002. They don't plan on deleting it until 7/2009! I sent the law plus other case citations to all 3 bureaus. Both EQ and TU deleted immediately. EX STILL won't delete!!!! Hence the lawsuit is coming!
