My ex and I filed for divorce 6/2/1999...he filed for BK later that same month. In our divorce decree it is clearly stated that the co-owned car would be his responsiblity and he would make the payments. His original BK packet does not list the car as part of the BK (He was going to keep it and con't to make payments). Later on (still in June 1999) he has the car repo'ed and the car lender releives him of the debt of the car (as shown in his BK file). Half of what was owed on the car is showing up on my credit as a charge off. The bank also sold the car for more than what they say I owe them. Can they do that?

    Please advise....

They can sell the car for more than you owe...they have to give you any overage...YOUR LUCKY THEY DIDN'T SELL IT FOR LESS THAN YOU OWE...THEY USUALLY DO...THEN BILL YOU FOR THE DIFFERENCE...

A lender has no obligation to accept any BK DECREE!!!!!!

THEY HAVE A CONTRACT WITH THE 2 OF YOU...THEY HAVE NO CONTRACT WITH THE BK COURT!!!!!
