I sent a procedure request to Experian, and they sent back a bunch of letters saying "this item has already been validated". So I sent EX another procedure request, this time writing in big black bold letters "this is not a validation request!". Well what was EX's response to my 2nd request for procedures? Yep...you guessed it...a bunch of letters with no information. How should I proceed next. I sent 2 procedure requests which basically went unanswered. Should I send them the estoppel? Or should I send an ITS? OR should I go ahead and file a suit??
I have sent a few, and have either recieved no response or something that has no meaning. I don't think I have ever heard of someone actually getting a proper procedural request back from EXP? I think they only time EXP will respond is by an ITS or claim, otherwise seems like they just ignore procedural requests.
Nope, or at least I haven't! Just got the whole "we are responding to your request to verify... blah blah blah... this item has already been investigated/verified" spiel in 2 separate letters. I don't have the letters with me right now - but it was crap. I've got a letter that I'm going to send them in response - I don't have access to it right now either, so I will post it in the morning if you'd like to have it.
TeeBee.... Can you please post that letter? I'd definetly like to see it. This is the 2nd time they blew off my procedural request, so I assume that is 2 violations right there, right? I'm steaming mad over this one, and I'm ready to sue their a**es. I may just send them an ITS with court papers ready to be filed. Maybe that'll get their attention. I start law school in Aug. Wish I had a few classes by now to give me a leg up on this whole process

I'm going to send this letter rather than an ITS, mainly because this particular account is scheduled to fall off in December, but I'm pissed because TU & EQ have deleted... Anyhow - here it is: Dear CRA: On xx/xx/xx, I requested to be provided with a description of the specific procedures followed by you, including the name, address and telephone number, of who you contacted in order to verify the information that I had previously disputed on xx/xx/xx and that you responded had been verified. The procedural request was made pursuant to FCRA, Section 611, Procedure in Case of Disputed Accuracy (a)(6)(B)(iii) and was signed as having been received by you via certified mail, return receipt requested, on xx/xx/xx. Pursuant to FCRA, Section 611(a)(7), you are required to provide that description and specific information to me no later than 15 days of my request. You have failed to provide me with the lawfully requested description and information within the timeframes specified by the FCRA and obviously must not have received the adequate proof as verification from the creditors that would have allowed you to verify the disputed information. Therefore, please delete from my consumer file, each of the following tradelines that were the subject of the procedural request: 1. 2. 3. I am not requesting a reinvestigation, I am requesting deletion of these items, as required by the FCRA. Sincerely, ********** If that doesn't get you anywhere, which I kinda doubt it will, simply because it's Experian, I'd go ahead & file on them. And I'd make sure you can show damages of some sort. You claim to have somehow verify erroneous information, therefore I legally requested a description of the procedures used to verify this information. As indicated by the attached copy of the letter and mailing receipt, on XXXXXX you received and accepted through registered mail my procedural request letter dated XXXXXX. To date you have not responded to this request and have thus not done your duty as mandated by law. Federal law requires you to respond within 15 days, yet you have failed to respond and it has been over 30 days. Failure to comply with these federal regulations by credit reporting agencies is investigated by the Federal Trade Commission (see 15 USC 41, et seq.). I am maintaining careful record of my communications with you on this matter, for the purpose of filing a complaint with the FTC should you continue in your non-compliance. For the record, the following information is being erroneously included on my credit report. Re: Re: EX procedure request games! well, for what its worth ... I am having the same problem with EXP. On May 28 I sent I letter similar to the one above to EXP and to the FTC. Within days of signing the green card, EXP sent back the same old "already been investigated" letter. I have not heard back from the FTC yet. I am hoping that the FTC will send a letter to EXP telling them to shape up and delete it. But so far, its still on my report. I'll let you know if it worked. I'm just exhausted by the whole thing. I think this is Experian's way of blowing us off, and hoping we'll just get frustrated and go away. I plan to send a modified sassy/teebee letter, cc it to the FTC, and see what Experian has to say to that. I'll keep everyone updated, as I know I'm not the only one who Experian is giving the run around.
