I disputed a Capital One charge-off and a DMB paid charge-off online with EXP. I disputed the amount of the Capital One charge-off. They still have three days left to complete the investigation. The DMB is still pending (hopefully it will be deleted thanks to the nutcase letter!) but the Capital One was completed a couple of days ago. Keep in mind that I have never officially received the results of the investigation because I have one thing still pending, but the Capital One was no longer showing as "under investigation". OK - now the bizarre part. The Capital One charge off went from having a balance of $1014 and being a charge-off to showing as "refinanced in 06/2002" - with the date of status changed to 06/2002. So I called EXP yesterday and I asked them what the heck this means - that I haven't refinanced anything - and I wanted to know if they knew why it said this. The lady told me she had no idea. So I say OK, hang up the phone. Later last night, I go back into CreditExpert and check again, and it now says the Capital One account is under investigation again. So I called them again this morning and told them the investigation had already been done and I did not request another investigation. The rep said that based on my phone call, they took it upon themselves to do another investigation. Now I am pissed. The investigation is supposed to officially be over on the 24th, but now they have restarted it another 30 days, without ever officially notifying me of the results from the one * I * initiated. Can they just investigate something without my consent????
Restarted, yes, but continued from investigation #1 maybe not...you will most likely receive notice of the original dispute 30-45 days after you submitted it by hardcopy, usmail (unless you opted to be notified via email, I have never done that). They are actually correct in re-investigating the claim based on your phone call since you mentioned to the rep that it was not correct, and the CRA's are tasked with reporting ONLY correct information (cough cough cough) ). -Peace, Dave
However, I specifically asked that this NOT be reinvestigated. I told them that I would contact Capital One. The rep agreed that it would not be reinvestigated.
And you trusted him/her?!!! LOL One rep tried to tell me addresses are a matter of fact. I told her that my address was a street that did not even exist with a zip code that was in another county...then I told her that I had a friend (Breeze) that was older than her mom...she still did not believe me and refused to delete the address. ))) I had it promptly deleted on call #2 but some of the reps will tell you whatever they want and whatever they think you want to hear "Maam, no this item will NOT be reinvestigated, I promise" - hang up - submit reinvestigation - take next call. -Peace, Dave
Duh - Boy do I feel like an idiot. Actually, I didn't think they could re-investigate stuff unless you told them to. I don't know why I care if it is or not - I guess I just don't want to look "frivilous" - but then again, I guess it really doesn't matter.
Try from the other direction. Capitol One has a real disconnect on their reporting right now. I've been working with Mr. Cooke since late last year trying to get my two old Paid Collections reported correctly. They were reporting with a currently 180 days past due status when they have been completely paid for some time now. I had given long since up trying to delete these accounts. They always came back verified, even though they were reporting a total of five different ways between six credit reports (3 for me, 3 for The Lovely Mrs. Quixote). After eight or ten good faith attempts to correct the listings, which I would have been happy with (even a Paid Collection is better than a 180 days past due, right?), I had a frank discussion with Mr. Cooke. I think of it as an Oral Nutcase Discussion. I told him I appreciated the good faith effort to correct the listings, which is true, but that given the repeated failures, and the fact that I am about to apply for a home loan (also true), and that I am very aware of Nelson v Chase Manhattan, as is he, maybe it's time he quits wasting his time on me and just delete the dang records. Either that, or I'm going to have to sue, because I'm just out of time. I can't wait while he tries ten more times. My lease option expires in 60 days. First acccount already came off. The second one should be Monday or Tuesday. That's twelve deletes. Clean enough to go get a prime mortgage. According to the Credit simulator on CreditExpert, that will have me knocking on the door of the 700 Club. Maybe even a little above that. Hope it helps.

That is awesome! These dang CRA's though - who the heck can figure them out??? If you want something re-investigated, they say "No Way!" and if you don't, then they do it anyway. Maybe we should all try a different approach - like - Dear Sirs: Please, whatever you do, do NOT investigate the following accounts. I am begging you. I know they are still being reported inaccurately but I DON'T WANT THEM RE-INVESTIGATED!!! I know you are obligated as an employee of Experian to re-investigate if a consumer tells you that an account is still being reported inaccurately, BUT PLEASE DON'T.
