    I think the odds are on the CRA's side and they KNOW it.

    1) Very few FCRA attorney's out there, the real good ones, mostly work for the CRA's
    2) Even if you do find a competent attorney, hope your case is LUCRATIVE enough for the attorney to accept

    Unless you can show a lot damages, you might be on your own against a CRA, most people won't do anything. I don't blame them. I *think* they (particularly EXP) know this and are somewhat comfortable about being blatant and notorious in their violations.

    Check with your local small claims court and find out what their basic procedures are for filing a small claims action.

    If your suit is based on Exp's violations of the FCRA, be aware that Exp could request to remove the case to federal court. At that point, Exp hires their lawyer and you get smacked around litigator-style. That's the worst case. The bright side is that you have the law and the facts on your side.

    I recently sued Exp in California and am now having to deal with collecting on my judgment against them. I'd be more than happy to share experiences.

    I have heard of their doing that...moving to fed court...it would seem to me that it would cost them, at a minimum, several thousand dollars to contest that, even if they were victorious. How many deletions is that worth? Is that worth the risk of a higher judgment than what small claims allows?

    What they hope is that pro se plaintiffs get so bogged down and flustered by rules of procedure that they miss a crucial date here and there and get their case kicked out. Moreover, some federal court judges can be fairly rude and impatient with non-lawyers.

    It's an intimidation thing--by the lawyers AND the judges.

    i've fought and won in small claims and federal court (both credit and non-credit items). i only bring my lawyer into it if it goes to federal court and then only for consultation.

    i doubt it would go that far - but hey let them run their lawyer bill all they want.

    The way they see it, it's worth $5000 to make themselves appear tough and unyielding. So if they have to spend $10,000 to win a $1000 lawsuit, they will. They're smarter than us, ya know.

    I agree with kickman, IMHO I think this is true regarding EXP.

    Frankly, I think this is their strategy against pro se suits almost regardless of the strength of the case.
    They will spend the money, probably a lot more than they are willing to settle for on counsel.

    My thoughts are that if they can overwhelm a pro se in litigation, the pro se will likely be discouraged and go back and tell everyone he/she knows not to sue them, strategy to prevent future suits.

    It just makes no sense to me why when they are so blatanly wrong to be so aggresive and hostile in litigation willing to spend thousands (maybe tens of thousands) in defense yet be so adverse to a more than lenient settlement on their behalf.

    How long do you think it will be before a thread is opened up on Creditnet saying someone sent a copy of their social security card and current ID but EXP won't change the the false SSN? Unable to verify, not good enough WTF? Would that surprise me? No.

    This is obviously a bonehead low paid employee that handled what you gave them. I'm sure this employee was in training at the time and their trainer said "good job, now your learning".

    I would fault both ends on this one also. The creditor actually sent you a letter but couldn't send the CRA the updated information on a account that is a done deal. EXP didn't even try to verify something that they probably told you to send I bet.

    ITS letters to the right people on both ends should take care of it like the others said.

    If it was me I wouldn't sue yet, but do whatever you have to do. Good luck though!

    IF THIS AIN'T PROOF THEN WHAT IS?

    I ONCE SENT A CRA A COPY OF A CANCELLED CHECK BECAUSE THE 0C WOULDN'T CORRECT THE LISTING AND THE CRA CORRECTED THE TRADE LINE ON MY REPORT.
