I recently disputed 5 items online on my report with Experian. However, only one notation is made on my report that "consumer disputes". I wonder what this means. Why don't the 4 other accounts show "disputing" also?? Hmmmmmmm....
I can tell you, for what little it is worth, that I have 2 pending disputes with Equifax, and that neither of them is shown as in dispute. If Experian is not showing all disputed items as disputed, document Experian's failure to disclose the disputed status of all items. This has now become a violation of the Fair Credit Reporting Act, which requires notation of any disputed items on a credit report. This is the first of two needed components to a law suit on your part, although the FTC is empowered to bring suit already. For you to bring suit under the FCRA, you may need to have damages. The best way to prove damages would be to be turned down for credit, preferably refinancing your home at a lower rate. I cannot advise you to apply for credit in hopes of documenting a legally actionable violation, because I have only been following this message board for a couple of months. The negative side effects of seeking credit including additional inquiries and your own feelings and capacities regarding lawsuits must be considered prior to taking this course of action.
Well I think I will give Experian a call today and let them know they are violating the FCRA by not listing the 4 items as "in dispute". I don't know what good this will do, but I will soon find out.
I just talked to Jose from Experian. He states that the items are being investigated, but they do not have to put a statement that the items are "in dispute". Can they do this????
I have a few disputes too and they told me that they don't put out a message until they complete their investigation. If it's not verified then they delete it. I'm wondering if this is legal.
I have taking this from the FCRA § 605. Requirements relating to information contained in consumer reports [15 U.S.C. § 1681c] (f) Indication of dispute by consumer. If a consumer reporting agency is notified pursuant to section 623(a)(3) [§ 1681s-2] that information regarding a consumer who was furnished to the agency is disputed by the consumer, the agency shall indicate that fact in each consumer report that includes the disputed information.
