I sent exp a letter citing my 3 attempts to verify a debt and demanding full deletion. How long do they have to respond? Its already been over 10 days and they havent started an investigation, deleated the tradeline or put a note on the report saying that the account is in dispute. Arent they already in violation? Which violations specifically? What responses have you received from them on similar requests? What should my next step be. Second letter with violations listed? Any good suggestions for letters?

did you send them certified? if you can't prove when they got the letters, you don't have much leverage.
Then, either they are marking it as frivolous and you will get a letter stating that or you should call them ASAP and ask what's going on.
i dont want to call them. But i will send them another letter. Is 15 days long enough? Or does the FDCPA allow them 30 days for investigation on this issue? Have they already violated laws since its been over 15 days and they have done nothing?
Well, I just faxed them something yesterday, but I'm not really confident in them getting it-or if they get it-they'll ignore it. I've spoken to a rep on the phone who says that she can mail me out a standard response, but they don't give individual proc. requests. I think after time is up for the proc. request, I'll mail them an intent/demand letter. I'm going about this kind of half @ssed, because I know at the very least they will update it as paid. I'm just holding out for full deletion. I didn't even send one of my letters CRRR, that's how slack I am on this. I have some of hubbys CA issues I'm dealing w/ now. I need to get on it soon. I'll let you know what I do. If it's still there, I'm going to dispute it during CHOD. It's my last derog, and I ran out of steam on this one. sorry I'm not more help. I'll whip up a demand/intent letter next week, giving them 15 days to delete or I file. I'll betcha I have to file to get this taken care of!!
Tracy, I too have been battling 4 negative tradelines with Experian that they refuse to reinvestigate. On September 17 I sent them CRRR a procedural request letter regarding these four items it was received on September 19. Today in a form letter dated September 28 I received the following: 1. A cover page listing the four tradelines with the comment "was previously investigated." Please note that in my letter, I stated that I was not requesting a reinvestigation but Experian's procedures. 2. Two paragraphs explaining how long information remains on your credit report and a general description of their verification procedures. 3. A copy of my credit report, which I didn't even ask for. 4. A flyer promoting their Credit Expert online service (already a member). In my letter I specifically stated that I was requesting the procedures used to verify these 4 items, how they were verified and who they verified with (employee name, telephone number or e-mail). However, I got the same garbage I always get. Anyway, I'm considering my next step. I'll keep you posted on my progress. Good luck to you.
I didnt ask them a request for their procedures yet. I started with the "I sent 3 letters for verification-got nothing- prove it or remove it letter." If they respond wth proof, ill send the procedures request letter. If they do nothing in 30 days Ill send the these are the laws you're in violation of letter/intent to sue.
I got that same garbage in response to my procedures request- creditexpert advertisement, a letter saying they are unable to process my request, and a copy of my report (unchanged). I still find it hilarious that right on the new report they sent me, it says: "The Fair Credit Reporting Act states that you may: -request a desciption of how we verified the information, including the business name and address contacted and the telephone number; if reasonably available" I just sent then my response today- a letter demanding they delete the accounts that they were unable to provide me procedure reports for, or I will take legal action. If they still want to jerk me around...I'm going to sue.
Did you send the letter to Experian CRRR? I'm probably going to go the same route as this is the only report I have with any negatives remaining. One of the 4 negative tradelines originally reporting is now positive thanks to the willingness of the creditor to cooperate. Another of the negatives is simply reporting 30 days late once and is due to fall off 8/2003 so I'm not even going to waste my time on that. I doubt at this point its even impacting my score. However, the two charge offs are a different story. I think that in my follow-up letter I'm going to ask them to refrain from sending my advertisement for CE as I'm already a customer!
