I've had a dispute pending with EXP since the end of March. They ignored it until i sent a letter after 30 days demanding removal. Then they put it in dispute with a due date of 6/11. I just got a response saying it's "still pending" and they've changed the due date again until the end of June. What do I do? I'm tired of waiting on this, and I need to apply for a business loan. I've reminded them of their responsibility to investigate within 30 days, but they don't seem to care. If I send an intent to sue, how many days to I give them to remove it before I actually file? I hate going to court, and I don't want to do it. Advice?
If you have proof you sent the dispute on a certain date and the date they recieved it. then You can nail them well.
Yeah, I can prove it. Not only do I have copies of the reports showing when they put it in dispute (more than 30 days ago), but the dummies also sent me the required response within 30 days, BUT their response merely says they are still investigating. Which of course, they can't do. So basically, they confirmed in writing that they are in willful noncompliance. I don't really want to sue. I just want it removed.
I would make copies of the green cards, their letters, basically everything that proves that you sent it and they received it. Send that CRRR with a letter stating if they don't respond then you'll take them to small claims court. The proof alone will force them to comply...
I'm trying to decide if I want to wait to see what happens. My EXP is handled by an affiliate (the same person gets every dispute I file), and I don't want to make waves unless I have to. I might need his goodwill later, if you know what I mean. If I give 5 days before I sue, that will take me up to the date when the thing's supposed to be back anyway, so I'm wondering what if anything it will accomplish to threaten. If, say, they wait til the end of the five days, and the OC verifies before then, are they then covered? Do they still have to delete? Or am I screwed? Another CRA wasn't able to verify this account, so I'm hoping it will be the same with EXP. I don't know. Like I've said before, it's a minefield, this credit game. What do you guys think I should do? Threaten or wait? I have no way of knowing what the OC is going to do. I've got the CRA on at least 7 real violations, all of which I could prove without even breathing hard.
