On April 4, 2003, I sent experian a letter requesting a re-investigation of a couple of things that appear on my report. 1 CA, 1 Judgement, 1 Charge-off. I sent in supporting documentation requesting a deletion based on these accounts could not be verified by me and that all information that was sent was sent with other people information,etc. To my surprise they said that they needed more information and could not begin an investigation based on the letter I sent and the supporting documentation. Basically a refusal to investigate. Today, I called Experian and the rep said that based on the information that I supplied they would have to send a manual investigation to the listed items and the investigation would take another 30 days starting from today. Questions: Can they give themselves this much time to do this, my CRRR states April 10? If I can't receive verification of an item, how the hell did they get it? What is the manual verification? Do they even investigate or do they just let any yahoo send crap about you and take it as gospel? What is up with their refusal to investigate based on the fact that they investigated before? Aren't they required to investigate if you have new information after validation? Throw me a bone please????? I am confused.
I thought so but it would be so much easier for them to remove this bs from my report. The rep had no problem with doing a phone re-investigation but wtf.
Well I just got off the phone with Experian and they told me they've investigated an item twice already - and will not reinvestigate. Hmmm.....on to the next step!
I had the same exact problem. I called up, asked to speak to a manager, got their name/ID#, told them my complaint, and my reasons why I felt that they must delete and that they had no right re-investigate. I patiently listened to their lame excuse. I then politely told them why I still disagreed and said "I will be turning everything over to my attorney for further processing". I then thanked them and hung up. A day later my credit report was corrected per my request.
ryder, was this for a deletion of a charge off or a late payment?? thinking of using your technique, but worry I might now have the confidence. I wish there was as sample phone dispute people could use that would increase their chances of getting a deletion. fyi got a "won't reinvestigate" letter today from Trans Union.
You can send Experian a Procedural Request with an ITS. They will undoubtly send you back a bogus procedural statement, but it will help your case if you have to file suit against them.
Well the rep gave Experian an out, she said that my name in the past was a wrong last name. I said that my name has never been that name and that I have always gone by the name on my reports. She said she thinks that there may be a case of someone else's file being mixed up with mine. I said well, when do you think this will be corrected. She advised 30 days. So essentially, experian has been doing an investigation for over 45 days. I am of the opinion that my next step is an procedural request with a ITS on all of these items based on the fact that I had to call and request an investigation while my letter clearly outlined that I was disputing these items and I did provide them with my correspondence from these agencies or the request for more information.
