I've just received a response from Experian after I disputed the 2 negs on my CR. Thier response: "previously investigated" with no other explanation. What's my next move? Ask for investigation documentation? Intent to Sue?
You send EXP a letter demanding to know (a) how it was investigated, (b) who at the creditor responded and (c) whaty the response was and (d) when the response was made. ITS if you don't get a reply in 30 days, sue 45 days after that.

Re: Re: Experian "previously investigated" I got a similar letter from them last week. I sent back a note saying the FCRA didn't allow them to shirk their duty because they'd done it before and threatening to sue. I also sent them a copy of my EQ results showing where they had deleted it.
Re: Re: Experian "previously investigated" § 611(a)(3) provides them the right to refuse based on being Frivelous, HOWEVER... a 2 word PREVIOUSLY DISPUTED response, does not comply with the requirements of the FCRA notice. Does it tell you what is required for them to investigate? the operative clause is the *AND* between (i) and (ii) the notice under § 611(a)(3) MUST contain both, or else its an illegal response, which means that the gov't intended that with enough information ANY tradeline can be disputed, even after it has been disputed and verified previously.

It mentions that if I still disagree, they will add my comments - which I'm not so sure that would be helpful. I've also tried disputing online and get the same roadblock. So anyone know how long it takes before you can re-dispute something with Experian? Is there any recourse with this form letter they send?
Re: Re: Re: Experian "previously investigated" all you can do is write them back and ask again. Try to send some additional information or pick another reason to dispute. The more specific and detailed your dispute, the less likely they'll bounce it.

The notice that it is frivelous *HAS TO* tell you what information they would accept to initiate a re-investigation, not the offer of a comment required under § 611(a)(6)(B)(iv). Under Eq's policy, you could have a signed deletion letter from the CA/OC and they could still refuse to accept it because they "PREVIOUSLY INVESTIGATED" it...

Re: Re: Experian "previously investigated" Experian sucks, plain and simple. They are the worst. They send generic responses whenever I ask for the nm, address and proof that the info was verified. They always, somehow miraculously verify when the other CRA's DELETE DELETE DELETE DELETE DELETE....I swear that EX is run by a freaking computer!
