Experian refuses to re-investigate a trade-line they verified in May 2002. Problem is that now the creditor has agreed in writing NOT to verify the information when I dispute with the CRA which would result in the deletion of this negative TL. Is Experian REALLY not obligated to re-investigate? Anyone know a way to make Experian re-investigate?
You are going to have to get creative and nasty at the same time. Exactly how did you dispute it in May 2002? What is reporting now? What has also worked for me once - they refused to reinvestigate for the same reason, so I sent them a letter with a copy of a letter from the OC. Of course, Evil Experian won't use it, so they put it back into investigation again. Do you have anything from the OC other than the letter you mentioned in the post?
I disputed on-line as not my account. It is reported as Paid/Past due. Creditor's Statement: Paid by Company who originally sold the merchandise. The Account History has 3-30 days, 1-60 days and 1-90 days. So I REALLY want it deleted.
When? I think if the last dispute was x amount of days ago, in excess of the amount of time their 'will not investigate' flag lasts, then the 'flag' on the account may have fallen off. When you disputed it in 5/2002, did you dispute as not mine? Maybe you should try another dispute reason. Thus, they would not be investigating the same details, making the investigation credible to EX. Just a theory that I have not tested yet, worth the try tho.
Well, since you say the OC has agreed not to verify, here is my suggestion. Write EX a nasty letter. Dear Idiots, In May 2002, I disputed this account as not mine, because I did not recognize it. Since that time, I have been able to locate the records for this account and after careful review, the company is still reporting inaccurate information. Then list several different things, wrong DOLA, you paid for merchandise not company, it was never late blah blah. These are serious inaccuracies. Then go on to quote 611 (1)(a), and tell them it is your right to dispute these particular inaccuracies, and they have absolutely no right to deny you that right blah blah. Since the OC says they won't verify, EX *should* either update to a good TL, or delete. This is my .02, others may have a different idea how to handle it. Good luck!
BTW - are you trying to dispute online? They won't take a 2nd online dispute, and you will have to send them a letter (CRRR of course).
I talked to Experian Special Services, no luck that way either. It was Verified on-line April 17, 2002 and May 18, 2002. I was VERY new to this back then and didn't know not to dispute so close together. Live and Learn.
I am going through the same thing with evil experian. I just send them a request for procedures by CCCR with some extra creative stuff, a copy of this or that supporting your claim with at little bah, bah, bah. I am thinking that a 15 day procedural request will trigger a standard 30 day investigation??? I also always mix up requests ill-regardless of the results. My thinking is that I don't want any definable pattern to emerge from the sum total of all the correspondence, as they could possibly view all my requests as simply frivolous from that point forward. this is just my opinion though, I am surely no expert on this subject. You have a good point. It seems every time I send them a procedures request they reinvestigate. Which is wrong, but it may serve your purpose.
