Arrrgghh! This time Experian really puzzles me. I got back a letter today from them telling me that my ch7BK liability amount I disputed was unverifyable. Then in the same breath, they say it remains on the report. some kind of crap about "schedules are only filed once with the origional paperwork" What would be my next step to deal with these fine people, or did I do something wrong? I would really like to squash this from my report. May bring me close to the 600 club... shawn
The way I understand it is that each account on your credit report must be accurate and complete or it is not supposed to be on your credit report. If a BK listing has been discharged and it shows it is not, it is inaccurate and incomplete; a listing with $0 assets and $0 liabilities is inaccurate and incomplete; a listing with the wrong court branch is inaccurate and incomplete. Remember the CRA's send people out to get the public information, no one reports it to them (the courts don't report it like a creditor would report account history). Funny though how out of three CRA's only one has the actual assets and liability listing on my reports. Since the entire BK filing is public record, they have no reason not to completely and accurately report they info. The CRA's are just being sloppy. If it's listed accurately that's one thing (you can always try to dispute it), but when the listing is wrong, that's another and a violation of the FCRA. BTW if you amended your schedules, they are still filed with the court. So schedules being filed once is wrong if you amended them. Of course if you did not make any changes to the schedules, then they would be filed only once. If one looks far enough into the filing, they would find a docket listing that would show an amended schedule filed. Every single event that happens in a BK case is docketed and becomes part of the record.
