I had a WRONG collection from IC systems on my CR in march. Disputed with all 3, TU and EQ dropped, EX verified. i sent letters to BBB and IC. IC promptly removed. i sent 2 letters asking EX how it was that they verified when clearly the CA couldn't do so by evidence that they pulled the account the very day they got my validation letter. Got my EX letters today. One letter said it couldn't find the account number i was talking about. then they sent me another letter explaining how they verify TLs without sending me any of the information i requested (the name of the creditor contacted, phoe numbers, addresses, etc). Isn't this a violation? What should I do next? Should I just drop it because the TL is now gone and it's all good? I don't think it's all good though because this stupid TL had lowered my score and i am really befuddled as to how EX verified this debt. thanks tboy
I would drop it and move on. The time and effort pursing something like that really is not worth it. If you have any more problems with any other accounts deal with those. I would keep records of what EXP did unless you have any problems with them in the future. The account is now deleted with all 3 and you should be able to move on and deal with your next issues. EXP is pretty hard to deal with unless you have a few violations to prove in court. Keep the paper trail though.
Experian removed the TL ... they didn't adequately complete my request though for inromation as to how they verified. I could just drop it since the TL is not gone but was wondering if EX was in violation and if so, if i should do anything about it ... tboy
If IC Systems deleted the account before you requested that Experian verify it with them, then either/or/both Experian and IC Systems violated some provision(s) of the FCRA/FDCPA. Experian either didn't investigate completely, or IC Systems verified it improperly, or any combination of the two. But once it's removed yes you could sue, but it's extra time, and money. Remember the #1 goal is to get rid of the tradeline, the violations are gravy to help them get removed if they won't budge... But keep the documentation handy, just in case the account re-appears, in some way...
