Hi, I need advice and/or a strong letter for Experian. In reponse to my dispute, they sent me my credit report with a list of my disputes as having "already been investigated." Now, I didnt just send them a dispute saying "Delete all my negative tradelines." There was very specific information in my dispute. Also (and this is almost laughable), with one of the tradelines, I disputed late payments that occurred AFTER they had "previously verified" this account (disputed late payments from 04/2003,05/2003,06/2003...experian reports that the account was verified on 12/2002). Should I send an intent to sue? OR, does anyone have a response to their "previously investigated" garbage response? And is this the same as them saying that my dispute is frivolous? I believe that is the ONLY TIME they can refuse to investigate an item or items. Thank you so much!!
Got this of a previous post...sometimes it's just good to do a search of the threads. Please investigate this matter thoroughly and remove this entry from my credit report. If you do not do so, I will be filing a complaint with the FTC and will likely seek damages in court fee allowed by the FCRA for your willful refusal to investigate. Under 611 (a) (3) Determination that dispute is frivolous or irrelevant.. You must notify me in writing stating the grounds for your determination and what information is needed for re-investgation. This was the part I added to my personal letter. The FCRA requires the credit bureaus to investigate all consumer disputes in a timely manner and it does not state anything concerning previous investigation unless you deem them of frivolous nature. After I sent that my results were 2 out of the 4 items I disputed were removed. Also remember you need to give a reason why the item is incorrect.
hang on a second. did you already have these TLs investigated once? how many did you do? why are you disputing again? how long did you wait between disputes? are these TLs being reported by CAs (as opposed to OCs)? have you tried requests for validation from CAs yet? 'already investigated' is not the same as 'frivolous'. the only time I ever got a letter stating 'already investigated' was when I disputed something with EXP via mail, and then accidentally disputed it online like 2 weeks later. (i got disorganized, lol) make sure you're being patient, otherwise you'll get this sort of crap from them. if you waited at least 30 days since the last dispute, and you're only doing 4 or 5 TLs at a time, then I'd go ahead and send another (concise) letter explaining everything, telling them you are aware that the TLs were already investigated, but they must not have been investigated as per the FCRA, because there are still inaccuracies. Tell them that they still only have until XX date to finish this new, more thorough, investigation. good luck.
I just tried to dispute an account that was last verified on 8/02 and Experian gave me the same answer "Account already verified"...guess that means only 1 dispute for the life of the negative mark...I'm having a horrible time dealing with these credit bureaus...

I hope you have another letter ready to send them. btw, had you sent them any NEW information with your latest dispute? Was this dispute done online? If this were me, I'd send another letter (CMRRR) along with some sort of "new information" (wink, wink) telling them you are aware the TL was verified, but that you have new information, and they are obligated to investigate again. No it doesnt! Don't give up. what sort of TL is it anyway? BTW, congrats on your new home! I love Wells Fargo, lol.
Hey needinfo, Yes when you try again online it will boot you out and give that message. It's probably best to send it in writing this time.
crowmom, thanks about the house...father-in-law is the loan person and helped us out a lot...the account is a mysterious cap one credit card account and yeah i plan on disputing it in writing again. dacoldest, yeah i tried it online and that's the message i got, but i'll send it in writing next...
