Okay to make a long story short, I disputed an item with Experian, it came back verified, I sent request for procedures. They never answered the request. I then sent them an ITS letter for their violation on the procedures request. Well today I get the old "previously investigated" letter on the tradeline I sent the ITS letter for. What the heck is this? I wasn't disputing the item again! I sent an ITS. So what do I do next, go ahead and file the suit for the violation? Experian is extremely screwed up.
I have been pondering suit against Experian as well and was wondering if ANYONE has different info in relation to their agent for service. In in Ca the SOS shows CT corporation systems as agent for process . next question is out of my own curiosity for those of you who have ALREADY sued experian for various violations was the outcome successful ? and did you have an attorney or file in federal court or in pro per?
i'm probably gonna be sending an ITS to EX for violations also. i'm bumping to get as much info as i can and hopefully someone has already sued them in Illinois, so i could find out exactlly how to go about it. dilla .
I sent a procedure request in April, received a letter from them stating this: "We are responding to your request to verify item(s) on your personal credit report. We have already investigated this information and the credit grantor has verified its accuracy.â? but I never asked them for verification, only a procedure request. I was very specific and said I wanted names and addresses and phone numbers. Wrote them again, asking the same thing and just got a response yesterday telling me the GENERAL way that they go about investigating items and no mentions of any name, address or phone number for the procedure request. What should I do now? I don't have the time, energy or money to sue anyone? Im afraid to threaten to sue in case they call my bluff and I'm actually hauled into court. I just want this crap off my report! What to do???
That is the procedures response. The only way to get a complete procedures response is to sue, and depose every employee who touched your complaint. Does the trade line itself have an address for the company listed? If not, then they are claiming that that information is not reasonably available. (But then of course, if they don't have the address for them, how did they contact them, other than electronically. )
In short, I sued Experian and won for their failure to remove an erroneous report. The other two agencies removed it immediately. It was the only one on my report, ever. I have an 800+ rating, even with Experian's erroneous info. They were fined over $2,500 by the court, and paid it (whinning). Even though they lost, they still report it! I directed them to incorporate my 'statement of dispute', and they refused! As I was out of the country, now upon return, I re-engaged them and they state they never have 'investigated' my file! .. and still have not incorporated my 'statement of dispute' since I sent it to them in 06. I am about to take them back to court, this time for $5,000.00.
In addition to the fine, did the court award include the injunctive relief of removing the information from the report?
An ITS to Experian is a joke. Jones Day represents them and would treat a failure to provide you procedures of verification as a nuisance claim. If that is all you have at this point (no inaccuracies w/ damages flowing therefrom), I would not advise you to file a civil action. It would be a dubious claim to say the least.
I am having the same problem with Ex. I asked them to remove a erroneous report and they claimed to have done it electronically. but when I asked for the info for the company, they claim they don't have it. i asked how did they dispute it. Then came the run around. The company I am disputing even the state of Ct could not find them so how could Ex.
