I waited 90 days before sending another dispute letter. ......I just got back a letter from Experian stating the accounts I listed was previously investigated. What does this letter from Experian mean? Does it mean they are not going to change a thing, or does it mean they are just letting me know it has been investigated in the past and they will look into it further? Please help, because from what I have read on the boards, pretty much tell me that, the three bureaus HAS to check into the matter if it is in dispute no matter what. Am I right? Thanks for the help guys. dimples1 ******************* battling credit HELL!
It means they rejected your dispute because you previously disputed the item. Experian does this allot and it seems to be getting more and more frequent. Try disputing online. See if you can get the dispute into process that way. I see you waited 90 days, normally I would say wait a month or so but that did not seem to help you. You are correct that they have to accept your dispute. Persistence is the key -Peace, Dave
They do not have to accept the dispute unless the consumer submits new information pertaining to the dispute. They are allowed to designate the dispute as frivolous unless new info is provided in the dispute.
I will try the dispute on-line, will it be wise to send another dispute to them now or later via certified mail return receipt?
I don't understand........I thought they had to accept the dispute no matter what. Am I missing something here?
You dispute it on-line, comes back VERIFIED #1. You dispute it on-line, comes back VERIFIED #2. NO MORE CHANCES... You can send the dispute by mail, fax or call on the phone...you must have "EXTRA" information...like a letter from XYZ BANK saying "we find no record of you ever having an account with us"
The FCRA, unfortunately, clearly states that the CRA DOES NOT need to accept a dispute if it is deemed "frivolous".
And what is "frivolous"? How can they say something is "frivolous" if it has been over 90 days since a letter was sent, and how can they say something is "frivolous" if they have not even attempted to investigate? I am totally confused.
The key word is "frivolous". They did not reject his/her dispute because it was deemed frivolous. They simply sent back a response that they refused to enter the dispute because it was already investigated. This happened to me. I received that exact letter from Experian, I still have a copy, it states: "We are responding to your request to verify item(s) on the credit report. We have already investigated this information and the credit grantor has verified its accuracy. blah blah blah..." Second page, next to the disputed item it simply says "Was previously investigated" I waited a month and re-submitted the dispute (ONLINE the 3rd time) ** poof ** it was deleted. By the way, have you sent validation letters to the creditor? -Peace, Dave
That is their way of saying it is frivolous. Their position is that if they investigated twice already and it was verified both times, the third request is frivolous in nature unless you have some new info to offer.
Dimples, how many times has this happened to you? It seems like dejavu Is it Ground Hog Day everyday where you live? -Peace, Dave
It has happened once, this is the first time it has happened. That is why I am so confused about this.
Yes, I sent validtaion letters the same day I sent letters to the 3 CBs. I have not heard any thing from the CAs about the letters, and Experians is already refusing to look into my dispute. I sent the letter one week and the next week Experian sends this back with nothing, with out Investigating . Can you see why I am confused?
As I said, I got that exact letter and was able to have the same item I previously disputed removed on the 3rd try and I disputed with the exact same reason I had on try #1 and #2. Just wait until mid to late April and submit an online dispute....that's what I did and third time was a charm. If you order a new report you get a new confirmation number to enter that may help also (not saying for sure). I think I used the same confirmation number from the one that got returned to me. I still do NOT think Experian was labeling my (or your) dispute as frivolous...they just rejected entering it. I would think that, since the FCRA states "must accept disputes unless deemed frivolous" that Experian would use that exact language if they were rejecting it for that reason. Although I am only going on past experience and reading this board, I am not 100% sure. Third time is a charm Dimples. As I said, I did #3 online while #1 and #2 were CRRR. Good Luck. -Peace, Dave
Thanks Dave I will take your advice and do just that. I will let you guys know the outcome. Dimples ******************* Battling Credit Hell!
Has any one else had this experience in the past? If so can you please share your experince with every one. Thanks.
Well back in December it was my husbands report I worked on, and since then I haven't sent any thing in until now. I sent disputes on his and my credit and I was the one who got this update from Experian, my husband has not received any thing as of yet. So I guess the will investigate his, it is my report they are having problems with for some odd reason.
It happened to me, while just trying to force my CC accounts, and my auto loan to update my report. They are reporting higher balances (and in a couple of cases older lower limits). In one case, I have an account that has been close, and they won't update to show it closed. I disputed, came back verified, LOL. I disputed again, they refused. I could probably sue them all, LOL.
