Ok the magistrate made his decision after nearly 11 weeks if anyone remember that far back when I sued experian. Keep in mind the magistrates decision goes before the judge for a signoff and experian can appeal which those arrogant fools will do. I was awarded $1000 + court costs and interest at 10%. Yes, by some miracle the consumer beat big bad mighty experian. they will appeal and win but damn it feels good putting those #^$#^%$ in their places. Guess what Experian? I am gonna file lawsuit #2 against you as soon as this one is finished. I told you if you screwed with me and my credit I would not stand back and take it. Now you gotta do what I asked or I will refile against you for the old violations you did which makes TWO more lawsuits.
Yippeee...I've been waiting for the results of this one!! Good! Dont forget to file on their D&B report, lol. I know you'll beat them on appeal as well.
There were a few threads. maybe you can look up my posts or something. I have a question though. I filed small claims so carla blair showed up and lied throughout the hearing. I bet the magistrate did not believe her because I let her lie and then provided proof she was lying. If this goes to appeal would carla blair show up or would they need an actual attorney. I figure this would cost them about 5-6k if they need an attorney with the fees and hotel and plane tickets, food, ect.
You misunderstand the purpose of the appeals process. It is not a re-trial - it is an examination of the PROCEDURE of the first trial. In other words, the grounds for appeal isn't "the judge found against me" but "the judge made the following procedural errors which denied me a fair trial". The Appeals Court generally will not overrule the trial court - what they can do is send the case back to the trial court for a re-trial, this time with the Judge following the rules of evidene ad procedure.
ahh ok. I filed for 3k which is my small claims max. I had them on over 60 violations but I guess 1k was the most he felt like giving. Even getting $1 would have been good. If I sued them over violations and won would they have to take care of those violations or would I just sue them again if they refuse?
because it was not done for the money. Heck, I only got 1k for over 60 violations. Do not fear- ever since the hearing they have gone overboard. What I have on them now is 10 times worse and 10 times easier to prove than what I had on them before. They will get annihilated when I take them back again.

CONGRATS..........its good to see people getting to the Big three I just got my Small Claims Court settlement in too from the courts the official paper awarding me 3,000 dollars funny thing TU transfered the case on the same day to federal court but the paperwork must never have gotten there also I amended my compliant in Federal court asking for a Jury trial and went from 3,000 dollars in damages to 250,000 dollars as I was turn down for a Mortgage refinance of 130,000.
Congrats, Picantel!!! If they appeal, often a small claims case is reheard "de novo" in circuit court. You would be free to ask for punitive damages and up the ante. They would also be saddled with more legal costs (yours) if they lose. Paying the $1K would be the smart thing for the CRA to do. Which means they will invariably do the dumb thing and appeal.
Wohoo Picantel!!!! EXP sux and they completely deserve to lose in court for their arrogance and apathy. So nice to see the "little guy" stand up to them and WIN. Congrats!
