I have an account on my credit report that isn't mine. I disupted it with the OC and the CRA. The OC verified it with the CRA. I spoke with the CRA and they said the OC verified my SSN, address and name. Well of course that will match. It's what's on my credit report. I want proof that this debt is mine. The OC has not sent me proof of the debt and won't respond to my requests for it. What do I do from here? I want this off my report.
I would write the OC a nice letter explaining that inaccurate reporting is a violation of federal law, with a penalty of $1000 plus damages. I would also include that if they are saying it belongs to me, please prove it or remove it. Here's another point: How long ago did you 1st rquest validation? I'd give it 35-40 days and then look at your CR, drct from the CRA's. If this OC failed to list the TL as "in dispute", another $1000 violation. My experience has been that when an OC or CA has not a shred of proof, if they do not delete the TL immediately and/or notify you they are to do so, then they are hoping you will not fight anymore and just pay it. They are trying to hang on to you! Don't fall for it. Lawsuit threats to a CA and OC when you know you are completely right seem to get them weak in the knees.

Just act as though you are joe schmoe off the street and don't let them know you are any wiser. i'd state briefly your dilema. let them know that you suspect they are inviolation of "some federal laws" and that in the event they continue to ignore you, it may cost them if you have to hire an attorney or sue them yourself. I seem to have good luck letting any OC/CA know I do know what I am talking about and not to f**k with me. I would be firm and throw around some knowledge, but not too much. If you are 100% sure this is NOT you debt by any means, than stick to your guns. I posted my validation process here, and there are 2 ITS letters in this series to work off of. Please note that you must have a good working knowlege of the FCRA here. The FDCPA will not apply to an OC, so don't qoute it. Re: Re: Re: Re: expert advice needed. Definately never cosigned and were never an AU. I have heard bad things about reporting fraud and identity theft on your credit report. So if at all possible, I want to avoid that.
