Hi, I had an account listed on my credit report that was not mine. I have posted about it here before. I have given the company over 8 months to prove the debt and they never replied. I finally sent an intent to sue letter. They mailed me an affadavit of fraud that I had to sign and return. Now they are telling me it will take 60-90 days to get it removed from my credit report. Well I find that time period ridiculous since they have already been given 8 months. We are currently trying to get pre approved for a mortgage and this account is holding it up. If we are denied because of this I am going to be Pi#@@d!! In the ITS letter we gave them 15days to remove the listing. Well their time is up and it is still on my report. They also never listed it as disputed. I spoke with someone in their fraud dept. today and she said that there are notes on my account going back to 08/03 showing that I disputed this as not mine and she didn't know why they never contacted me. So this tells me that they have been KNOWINGLY reporting false information since 08/03!! I am going to go ahead and file suit but I need some help on the exact FCRA violations here to list in my suit. I have them on some violations but i don't want to miss any. Also, I am not sure how much to sue for. Any help here would be greatly appreciated.
