I am in the throes of disputing about four R9 stubborn tradelines that are proving to be very difficult to remove. I have disputed each account 2 or 3 times with Equifax. However, all still remain. In the middle of my 2nd rum and coke tonight (yes, I am smiling and feeling good), it finally hit me to dispute (as many of you have already advised) all late delinquencies. However, instead of disputing this as "please verify all late delinquencies", I thought it would be best to list each request for verification individually. What do you think of the following letter I intend to send to Equifax. Here goes: "In response to Equifax investigations conducted against Report No. XXXXXXXX, I still remain in strong dispute of the BofA tradeline. Therefore, I request Equifax to verify via telephone with a representative of the tradeline in accordance with the following requests: BofA, XXXXOOOOXXXX â?? Request Equifax to verify and report the following: -- Equiifax reports 5 times 30 days late. Request Equifax to provide dates of ALL 30 days delinqs for this tradeline. â?? Equifax reports 4 times 60 days late. Request Equifax to provide dates of ALL 60 days delinqs for this tradeline. â?? Equifax reports 5 times 90 days late. Request Equifax to provide dates of ALL 90 days delinqs this tradeline. â?? Request CRA to verify and correctly report all 120 days delinqs for this tradeline, as it is in a I9 status and must at some point reached 120 days delinq. â?? Request CRA to verify and correctly report all 180 days delinqs for this tradeline, as it is in an I9 status and must at some point reached 180 days delinq. â?? Request CRA to verify and report the date in which this account was closed by the creditor. â?? Request CRA to verify and report the date in which this account was charged off by the creditor. Reporting of the above information will assure me that this account is being reported correctly. If Equifax is unable to verify and report ALL referenced delinqs, closed account info and/or charge off info as outlined above, I request Equifax to immediately delete this tradeline. Further, I request the following from Equifax: -- Request Equifax to provide me with its procedures for verifying this information. -- Request the name of the tradelineâ??s represent. and telephone number supplying this information. -- Request the name and full contact information of the authorized representative at Equifax investigating this dispute. I assure you that this is not a frivolous request, as this is a serious matter that is being incorrectly reported and deserves your full attention and investigation powers, as I am genuinely concerned that the tradeline is incorrectly reporting and re-aging this information, which is a serious problem for the tradeline, as well as Equifax and leaves your company vulnerable to legal action. FYI, this request has been sent via Certified Mail No. 9999999999. I request an immediate response by Equifax within the 30 day period as allowed by the FCRA. Sincerely, Posters, I plan to try this strategy out on BofA first. If successful, will dispute all 3 remaining tradelines this way. BTW, the BofA tradeline is reporting as follows: DOLA: 1/97 (previously verified disputed/verified) HISTORY: 5x30 days; 4x60 days; 5x90 days late STATUS: 12/96-R5; 11/96-R5; 9/96-R4 All of the above has been previously disputed and then verified. Seems to me I have nothing to lose! What do you think? Please remember I am NOW in the middle of my third rum and coke! Thanks as always,
I should explain that the reasoning behind my request for the correct reporting of the delinquent information is to: 1. Hope CRA can't verify and therefore must delete. 2. Hope CRA or Creditor will attempt to lie and report bogus delinquent dates which would allow me to again dispute that this information is not reliable as the tradeline had been verified as correct on 2 or 3 occasions and is now being revised to suit the creditor's purpose. 3. Hope CRA or Creditor representative that is assigned this task is too azy to check all this information and will therefore delete. The account is paid in full.
Here's two FTC opinion letter links that address how important those dates are: http://www.ftc.gov/os/statutes/fcra/johnson.htm http://www.ftc.gov/os/statutes/fcra/kosmerl.htm Sassy
Thanks, sassyinaz Do you think I should reference either of these FTC opinion letters. Please advise as I can't think of any other reasons to dispute these tradelines.
I think it's important because you have multiple dates and no clear 7 year reporting date. It's not accurate if they aren't showing all the dates. Add the dates or delete it. They have to be able to verify, if they can't verify, delete it. Those 2 letters just speak to the importance of having a single date to base the reporting period on, that's why when the FCRA was amended it included the provision for a specific this is where you start counting from date. Having the multiple dates, and especially unstated multiple dates, just made it easier to expand the reporting period without notice. If your tradelines aren't prior to 1997 and it seems like they were close, ask them to verify the reporting date being used for aging the tradeline off or if after ask for verification of the month and year immediately preceeding the commencement of delinquency date and when it was reported. That's a specific requirement. Or, send off your letter, they'll either have their records in order, LOL, or it'll work, whatever remains use the commencement date and it's reporting as new information for another dispute. I'd add, should the information be verified you request to know how it was verified, who they talked to, and their contact information -- address and phone number. Good luck, do post back your results. Sassy
Sassy, thanks again. Will add your comments and mail Equifax my dispute tomorrow. Also, will post results.

I'm anxious to hear the results of this strategy as well. Sometimes the BEST dispute letters are written while parktaking of spirits!
