Briefly - We signed up for Clear Credit back in July and since then our credit reports are being nailed with hard inquires. My husband and I each wrote to them back in September and received our green cards back, but have heard nothing from them. I am sending them another letter from each of us and wanted to know how this sounds. Also, is it ok to put both of our letters in one envelope or is it better to mail the seprate. I am using certified mail RRR. Thanks for the input in advance! ~Shelley ------- ClearCredit, Inc. 65 Enterprise Drive Aliso Viejo CA 92656 Phone: (949) 330-7400 or (800) 720-5614 Web Address: http://www.clearcredit.com Principal Contact: Aaron Jones Bureau ID: 13130143 Other Known Addresses: 1590 Corporate Center Drive Costa Mesa, CA 92626 2224 Main Street Santa Monica, CA 90405 ATTN: Legal Department ClearCredit Inc. October 17, 2003 To Whom It May Concern: I wrote to you on September 22, 2003 regarding the situation below. You received that letter, which I know because I sent it certified mail, return receipt, and I received the green card back on October 6, 2003. At that time I requested that your respond back to me, via USPS mail within 10 days of the receipt of the letter. I have not heard back from you yet. I will go over the problem again. I signed up for your service for credit repair, and credit repair only. I did not apply for credit, a mortgage, employment, or anything else with you. As per my Equifax, Experian, and TransUnion credit reports, you or companies on behalf of you obtained my credit report on July 2, 2003 and now I have discovered, also on October 4, 2003. These inquires are hard inquires which are reported as SCORE LOWERING inquires to Equifax, Experian and TransUnion, reported to creditors and Fair Isaac. You are NOT helping my credit, but instead LOWERING my credit scores. As of this date, October 17, 2003, the following HARD inquires have been made to my credit report by you and on behalf of you. I have verified with each company that these inquires were made on your behalf. Equifax >> July 2, 2003 â?? INFO1-NY >> October 4, 2003 â?? Quality Mortgage Reporting Experian >> July 2, 2003 Credit Decisions/INFO1 Mortgage Reporters TransUnion >> July 2, 2003 â?? IQUALIFYNOW.COM/INFO1 >> October 4, 2003 â?? IDENTITYWATCHDOG./QMRMTG Please note the following: From the FCRA § 616. Civil liability for willful noncompliance [15 U.S.C. § 1681n] "(b) Civil liability for knowing noncompliance. Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or $1,000, whichever is greater." I did not give my permission to have my credit damaged by having my scores lowered by you or the companies you contract, therefore you had no permissible purpose. Please arrange to have these inquires recoded so they will no longer damage my credit rating and arrange for payment of $1,000 per report inquiry (per the FCRA) within 10 days of the receipt of this notice. Please respond via mail to: My Name My Address On a final note, thank you for finally canceling my account with you even though it took many emails and much frustration on my part to finally have that simple task completed. Sincerely, Signed me
Hi Shelley, I agree your inqs. should be soft, (AR), but are you quite sure you didn't give them permission to pull your CR's? I went to their terms, which is quite long, but didn't see anything. I didn't examine it carefully tho. Are you sure there's no permission in any of your paper work, or online application? ???
Well ... I guess here's the important thing. When, as in what day, did you notify them that you wanted your acct. cancelled? How did you notify them, and can you prove it? ???
Butch, Sorry, was out of town for a day. When I signed up back in July, there was nothing in the terms that said they were going to have my credit report pulled by anyone at all. I assumed they themselves would pull it and it would be a soft since they are all about fixing you credit, not hurting it. They claim you account will be ready to go within 4 days. I check back in a week, nothing there. We can access the accounts, but there is no credit reports, nothing. I wait another week, still nothing. I email them and ask them what is wrong since the credit reports have not been added to our accounts, etc. No Reply. I write again. They write back and tell me to double check our info, such as address, etc on each account. I do, it is fine, I let them know this. We wait some more, End of August now, STILL nothing in the accounts. We say screw it, we will work on fixing our credit ourselves. We email them using their form, tell them we want both accounts cancelled and why. Never hear anything back from them. I try calling them. can't get through. In the meantime, we are working on fixing our credit. I get our credit reports and all these inquires are on there. I posted here, asked if anyone knew who this was and I got directed to another message board with info on these companies. I started reading and realize that it isn't just 'us'. This company has done this to other people too. They also changed a few things in their terms in August to reflect that they would inquire, but when I signed up it wasn't there. I follow the advice on the other board and send them a letter, certified - RRR pointing out they did not have permission to have these companies pull our reports, and I requested that they close the accounts. I also sent a letter to each of the companies requesting that the inquires be recoded and mentioning the law regarding the amount that I would be entitled to. I get the green cards back from ClearCredit and still hear nothing from them. I try to log into our accounts and can still get in them, and now suddenly our credit reports are there. So I write them again, and wasn't very pleasant. *LOL* They write back and tell me I have to call to cancel. I wrote back and told them BS!, My emailing them numerous times and the fact that I sent them certified mail, which they received requesting the account cancelled should be enough. They write back that the accounts are closed. I check, they are. Fast forward to now. I pull our credit reports, and there are more hard inquires. I call these companies and they tell me that IQualifyNow requested they do this along with Clear Credit. So in summary, we sign up for an account with Clear Credit. We find hard inquires on our account dated the date we signed up with them. They are from IQualifyNow, Info 1 and Credit Decisions (all the same company, just inquire under different names on different reports). Some are coded as real estate credit inquires and mortgage inquires. We call this company, they say they pulled them because we signed up with Clear Credit and Clear Credit passed the info on to them. Now the beginning of Oct, we have more hard inquires from Quality Mortgage Reporting and Identity Watchdog. (according to QMR, IdentityWatchdog pulled though them on behalf of Clear Credit. I call IdentityWatchdog and they say yes, that is true and that they have set up accounts for us too at identitywatchdog.net. I tell her to please cancel them as we did not request or give permission for them to pull our reports. I explained to her that it was not disclosed anywhere when we signed up with Clear Credit, therefore we did not give permission. She apologized and cancelled the accounts. So, I still have not heard anything from ClearCredit, which brings me to the letter I posted. From what I have read elsewhere, IQualifyNow has been sending checks out to people who have contacted them. So that to me tells me they know they are wrong. So that sums it up pretty much. ~Shelley
