experts pls advise: CA reported to CRA during 30 day validation

    experts pls advise: CA reported to CRA without sending proper validation

    Traffic ticket. A person appears in court and if that person is not able to pay the entire amount of ticket, that person signs a time/pay agreement to set up a payment schedule with the courts. I was unable to pay the $2000. After three months, the account was turned over to a CA. The CA adds another $1000 to debt. I never receive any paper work by mail from the CA within the 30 day turn over from the court. I did speak with them on the phone once and told them I would pay $25. I did not do that. Four months later I get a threatening letter that they will initiate legal action if I do not make payment in 7 days. Since I had never receved any written information from them, I sent a letter of validation to a CA. In the process of their validation, they discovered there had been no signed time /pay agreement with the courts. They claimed I took both copies when I left court the day I was originally sentenced. Without that time/pay agreeement, the court had nothing to turn over to collections. The CA contacted me by phone and told me they were turning the account back over to the municipal courts for collection. They told me there would be warrent out for my arrest. I spoke with the court. What will happen, is a summons will be sent by mail to me to appear in court. At that time a new time/pay agreement will be signed. No warrant. The CA never sent me a letter of validation or explanation (in writing) of what went wrong in the process of their receiving the account without a proper signed contract. I am two weeks into the validation process right now. I went in to apply for a loan of $500 last week. They pulled my credit report and 'low and behold' there is my $3000 fine reported by the CA. The bank pulled TU. I had not seen TU since I began investigating my credit. I am not sure when the debt was reported to them. I had a solid co-signer but was turned down for the loan and the rudest way!!! What sort of action can I take against the CA??

    #1) There is nothing preventing a CA from reporting during the initial 30 day period.

    #2) Tickets & fines are NOT debts under the FDCPA, so validation is not applicable under the FDCPA.
