Hello all! First I would like to say I have learned so much from everyone on this board. I started of with 13 charge offs on my report in September and now I am down to 5!! I started a dispute with Equifax. I sent it to the address for disputes CRR. Their signed dated was 11/10/2001. Based on this I figured their 30 day period ended on 12/10/2001. I called them up to find out the status of my dispute this morining and was informed that the "Post office" received it on 11/10/2001. Their office received it on 11/15/2001 and they began the investigation on 11/16/2001. Therefore, the 30 day period commenced on 11/16/2001 vs the signed date on the CRR. Does this sound right? Is anyone aware of an FTC opinion letter regarding this? I checked the FCRA and it does state the reinvestigation must be completed before the end of the 30 day period beginning on the date which "the agency" receives the notice of dispute from the consumer. Is their P.O. Box considered the Agency?
I would think that the clock began ticking the moment Equifax's internal post office date-stamped it, not the date the department handling your inquiry receives it. CardKid
