Exterra Popped Up on Wife's EQ...

    ...on her 1/24/02 report, but it wasn't there on 1/18/02 (Yes, I'm using Equifax Credit Watch). We received NO NOTIFICATION from EQ or Exterra. What do I do? This collection account is due to dissappear by 1/2003, but we can't afford the bad mark. Help!

    Was this item previously disputed and deleted??

    If so do you have the confirmation of the deletion?

    If you do, fax that over to Equifax with a letter informing this item was previously investigated and deleted please see enclosed copy of deletion, also inform they never notified you within 5 days of the reinsertion and to please remove.

    I would suggest you wait until five days have passed since this turned up, b/c alerting them now depending on when it popped back on may give them the window to send you notice on reinsertion. B/C they only give you the month/year it was updated, not the day.

    Good point, but it says "updated 9/2001". I believe it was on my wife's EQ before, I'll have to go home and check it...

    Are you going to pursue the $1,000 you can get per violation?

    If the item was previously disputed and deleted, they cannot re-add it to your report without notifying you--actually, I wanna say they have to notify you within 5 days. Either way, if this was previously deleted and they didin't notify you, you can sue them for damages--that's the $1000.

    If, however, it simply wasn't there before and then suddenly popped up, all you can do is dispute-dispute-dispute until they get sick of verifying, especially if it's paid. If it's not paid, you have some wiggle room. If it is paid, you might try searching the archives for the nutcase letter.

    Well folks, last night I went through my wife's EQ files, which we began receiving as of 8/01, but the Exterra collection was not to be found... :-(

    But isn't it strange that it "popped-up" with a reported date of 09/2001??? There's gotta be a loophole here somewhere...
