I have 2 accounts that have failed to provide proper validation within 30 days. One is a paid collection and the CA sent a letter pretty much stating that the debt has been paid. The other is an unpaid CA that sent a list of payments made and who the debt is from. I know that this isn't proper validation and I am not sure what to do next. Any ideas??
Validation is not properly used in a paid chargeoff situation. Validation demands they prove that a debt is owed among other things and if a chargeoff is paid then obviously no debt is owed. Be that as it may, one does have a right for a review of any account at any time for any reason but one may also have to sue to get it. It isn't done because it usually isn't worth the cost of the suit. You say it was a list of payments made but did it also include the charges to the account that caused you to make the payments? What to do next would depend on your answer to that question.
There were no list of charges. the letter only contained who the debt is from, the amount of original debt and a list of payments made. I have read that the "nutcase"series is the way to go with paid collection. I am not sure if that is best in all situations. Also, I have read that some people submit goodwill letters over and over trying to get someone to delete the negative trade lines. Do you recommend this approach? I have read and read this board and I have been hesitant on how to proceed. I have disputed these accounts with the CRAs but they have come back verified each time. Thanks for your help.
So this is a paid chargeoff then. Validation isn't going to do you much if any good. Doc's nutcase letter is supposed to be great. Lots of people have praised it. I have one that I call a paid chargeoff estoppel letter and some folks say they have used it with success too. Just like Doc's series of letters, mine is free too.
