FAKO takes a 200 point dump!

    UUGHHHH...

    I have had several (23 derogs) deleted from my tu report.

    Checked back and they have reinserted some really old tuff...BUT they reinserted it with dates as current as last month.

    2 charge -offs originally from 99...new date is 2/2003
    2 collections from 99...new date is 10/02 (duplicate account held by differennt ca's.

    I am pretty livid...

    Had faco of 648...now it is (gulp) 448. WHata CROCK!!!

    Not sure now how to go back and get dates right. I have old reports from before they were deleted that show correct dates, but if I call tu, then here we go again with the same old game...GRRRRRR

    That really sucks. But you would have a good suit if you have to go that far IMO.

    sometimes this crap just makes you want to fling all the papers/files in the air and go illegally change your ss#...JUST KIDDING!!

    You guys are the little soldiers rolling a stone uphill (that would be ME, lol) Thanks for the support.

    Do you (or anyone) have a fax number for the Special Handling department?

    I have a fax#, but I think it is a general number. On your fax cover sheet. put in big letters:
    ATTN SPECIAL HANDLING Dept.

    714-447-6032

    I attn my stuff this way and it is forwarded to the right dept.

    I'd send them a copy of your old reports along with the new one with some choice snipets of the FCRA.

    Give them 72 hours.

    Good call...sometimes I get so pissed, lol, it is better that I wait until I cool down so I dont shot myself in the foot. Of course, I know they wont respond within 72 hours...I'll probably get a form letter response.

    So, help me out here...sorry, I am so flustered, cant think straight...

    What exactly have they violated, if anything?
    I got my 5 day reinsertion notice.
    It may not be tu's fault all of this info has come back with the wrong dates.

    I will send them an old report with the correct dates on it, saying that the chargeoff date may not be updated, etc. Just want to be sure I am clear and concise when I give them 72 hours to respond...need to make sure that I am 100% correct and right on the mark, in case I need to follow-up with a petition.

    Please help guys!

    They are reporting a grave inaccuracy- showing an item originally COd in 1999 and recent as 4 months ago.

    Will start piecing together a letter w/ statutes (grumble grumble)

    This is SOOO frustrating. On the other hand, divine intervention helped us to sign on our truck 3 days before reinsertion. Geez...

    Well, if a creditor reinserts, they are supposed to certify the accuracy of the information to the CRA they provide.

    Your accounts have been wrongfully re-aged. If the CA's did provide certification as required, then it would seem like they would be in some hot water for certifying the incorrect information in the reinserted account.

    You can try and call TU and ask if the reinserted accounts were "certified". I think the only way you would really know if the accounts were certified would be to file a claim and subpoena records from TU and CA's regarding the reinsertion.

    If it were me, I would dispute again, stating the accounts have been re-aged (provide no documentation to support the dispute, they might just change your dates according to your reports) wait the 30 days out, and if the account remained, I would start filing.

    ) Information deleted under Subsection (d) may not be reinserted in the consumer's file unless the person who furnishes the information to the consumer reporting agency reinvestigates and states in writing or by electronic record to the agency that the information is complete and accurate.

    IMHO, it sounds like TU's system reinserted the information, rather than 4 different TL's being rereported. I learned that TU has deletion, then they have DELETION.

    I asked some questions re: WHO provided the info...tu says the creditors updated the info...when I spoke with oc on one acct, she said the correct charge off dat, not what was reported as being "new". Still waiting to hear back from tu.

    Okay, beginning to get somewhere...

    So far, 1 charge off that was reinserted will be re-deleted.

    A couple others were verified...originally deleted for no-response. Still waiting for her to check on a few others.

    Well, at least I've gotten 1 deletion back.

    keep in mind that after 30 days they need more then just verification to put it back - they need certification...
    Also, according to the FCRA the frunisher has to finish their investigation w/in the CRA's 30 day time frame.. I'd think that even by "certifying" their results the furnisher is still in violation after the 30 day's, the only difference being that with the certification the CRA can re-insert.
    Stuff to think about, maybe there's something to work with..
