I send off my second letter to First Consumer National Bank to correct my payment history. I gave them seven days to respond. I included the first letter I wrote to them. They received it on Nov 8th. I can not believe them. Not one word. They never responded to the first letter of dispute either. What is wrong with them. I have the letters and the certifications notices with signatures and time stamps and of course documentation that proves I'm right that they have seen. CCCS has been trying to help me and get the same run around that I get. They tell him they can't even pull up my account. He then asks them why then is it being verified when I dispute? No answer. They did say it was they policy that after three months that they would re-age the account...which they never did for me. I did receive a letter when I did an inquiry from them sometime March 2001 which they said they were removing any derogatory information from Feb 1995. I was never late in 1995 and that wasn't being reported to the CRAs anyway. I am calling CCCS tomorrow to get their paper work of my payments together so I can send it off to the FTC and contact my state attorney. Is there anything else I should do? I know some of you said in other replies about filing in small claims court. I can't believe how stubborn FCNB is being. Thank you all for your previous replies and help. Kind regards, Bunni
Unbelieveable! Absolutely unbelieveable! That bunch of knotheads still have not learned their lessons yet. They never seem to learn. I've sent them to school a couple of times or so and all they seem to do is eat the pages. Every time they get whanged across the head with a hard proposition, their eyes just roll a bit and they pay up and go do the same thing all over again. Then there is NCO. They never learn either. But at least they act like they might have enough intelligence to try to duck, but it never does any good either. They keep on making the same mistakes too, pay the price for stupidity and go right on and do it all over again. Both of them are headed to court about the next time they pull their stupid stunts and it isn't going to be some piddly little small claims court deal either. Next time we will see how many thousands we can get out of them.
You may never hear from them. However, 45 days after sending them a letter regarding incorrect reporting of payment history on a closed account, I got an updated credit report. The credit report reflected that changes had been made--I had an unblemished history. You are looking at 30-45 days for results. FCNB never sent me any sort of letter, but they got the job done. I found out about the update within the last 2-3 weeks. cariba

Marci/Sumitra, Now that I recall, I wrote them a letter. They then sent me a form letter requesting a copy of the credit report pages showing the info. I then faxed that to them. I can go in my files and check the dates. I would have liked to have gotten notification from them that they would correct it, but I was very satisfied when I saw the results. cariba
I currently have an FCNB account and I had a closed one showing 2x30 days. I basically talked about our 40+ month positive business relationship and how I would hate to see it end. The late pays were consecutive and around the time I had moved back in 95. I asked them to also check my current payment history to see the way in which I pay my bills, I value my good credit--worked hard to build it--yada, yada, yada. So, I basically threatened to close. I have carried big balances in the past but am now at zero balance, and I guess that they did not want to lose me as a customer. cariba

Cariba and everyone else, Thank you for the information. The first letter was written in August and I have checked just recently with the credit bureaus and nothing has changed. I have learned something new today about my account with CCCS and FCNB. They have a new director over CCCS and she told me that looking over her files that she saw a second letter back in February 1998 from FCNB not accepting the terms of payment from CCCS. They were never changed. I was never informed from either party. If I was told by either party, I certainly would have agreed to the new payment. She thinks that is why I have all the late payments on my credit history. They accepted CCCS payment but reported me late every month but they never charge late fees. However, when I ask FCNB why I keep having delinquent statements written to me and stated on the top of my statements I was so much past due, I was told it was because they did not re-aged the account yet. So where does that leave me? I read my agreement with CCCS and it said that I agree to hold them harmless from any claim, suit, action, which in any manner may arise from any inaction taken by the agency, in connection with any services given by the agency for me. (paraphrase). It is not my fault. What about FCNB? They did not inform me. I keep asking what the problem was for over a year. You would think someone would know. All I was told is because that account wasn't re-aged. I just read the FCRA. It looks like that FCNB must include a notice of my dispute..which I have not seen yet. I am also looking for a letter from FCNB (if it exist, I don't remember) that states I was accepted with CCCS under the first agreement. So do I have any options left? I know that CCCS is trying to talk higher up (and thanks to you guys I have names, addresses and phone numbers to contact) to see if they can come to an understanding. Thank you again for your help.
