Here's the deal: I rec'd a dunning letter from Platinum Recovery Svcs (based out of Omaha, Nebraska) for CO FCNB account. I DV'ed them and heard nothing until today when I got some package with all my FCNB statments. That's all they gave, no authority of them collecting this acct nor original signature. But when FCNB went belly up their statements went from FCNB to Cardmember Service, Omaha, Nebraska. Obviously, Platinum is Cardmember Services (such as Westmoreland is Capital One). My question is this, Cardmember Services is acting as an OC and one of my credit reports has their address but with FCNB as their TL name. Is this legal? Furthermore, aren't they now a CA and bound by FDCPA? What should be my next course of action?

Statements were from acct. inception and from the OC although they were sent from the CA. They add up. Not terribly sure here Dogwood, but whether it is or not I don't think you could do much with it. They'll just claim an inadvertent one time error. hmmm? Depends entirely upon the status of the account when it was transfered. If an account is transfered PRIOR to official default the new owner may act as an OC, or a CA in some cases. If POST default the new owner MUST act as a 3rd party collector. I believe it was CO'ed. What should be my next course of action? Typical questions: How old? 1 yr. How much? almost 2k. What state ya in now/at the time of application? NJ
