Okay here's the deal: I have two collection accounts listed on Equifax. I mailed Debt Validation letters to: MEDCLR and Marlin Integrated Capital on 4/24 Received green cards back on 4/28 Accounts were immediately listed as "CONSUMER DISPUTES-REINVESTIGATION IN PROGRESS" Just pulled report on PG, both of these accounts have been updated to show "120 days late" and the "CONSUMER DISPUTES" is now gone. Doesn't this mean that they verfied the debt to equifax? And if so, they are now in violation of the FDCPA? I have received zero information from there in regards to my debt validation. Should I now wait until the 28th to send out my estoppel? Thanks.
I am confused here, did you also dispute with the CRA's as well I saw a post here where someone was asking what shoot can't remember the exact wording but on her report was a note from the creditor that it was in dispute darn let me see if I can find it
I did not dispute with the CRA's. The "CONSUMER DISPUTES" was placed onto the credit report by Marlin and MedCLR (really NCO). I did a blanket "not mine" dispute with Equifax before I sent the DV letters and they both came back as "checked". Not sure why the "CONSUMER DISPUTES" statement has disappeared unless Marlin/MedClr reported new information to CRA. It is very confusing...sorry.
If you did the dispute with the CRA before sending the DV letter, then they didn't violate in verifying, if they verified before the green card was signed. The notice of dispute should have been reported for all future reporting, so that would appear to be a violation.
