1. what's the CC definition of "delinquency"? I ask this b/c I have a trade line in which mu DOFD is 9/2005, however, the account was primarily past due for the majority of the months prior. Records show I made the minimum payment at times which reset my DOFL to 9/2005... but my question is if the account being over the limit is still considered a delinquency in this case. If so, then I can try and argue my DOFD to 2/2005, thus hitting the 7 years and being removed from my CR. This is with Chase bank. 2. Not sure if this makes sense on my CR. HSBC account Status: Charge Off Date of Last Payment: 5/2009 DOFD: 12/2009 Balance: $0 Charge off amount $0
1.) FCRA Staff Opinion: Brinckerhoff-Johnaon 2.) hmmmm, DOFD should be 6/2009 if the last payment was 5/2009, unless there was some reason why you wouldn't need to make a payment for 3 months. (Same reason as the quote in 1.)) 3.) A charge-off doesn't negate that an amount is past-due. Just that they had to write it off in their books.
(5) Duty to Provide Notice of Delinquency of Accounts (A) In general. A person who furnishes information to a consumer reporting agency regarding a delinquent account being placed for collection, charged to profit or loss, or subjected to any similar action shall, not later than 90 days after furnishing the information, notify the agency of the date of delinquency on the account, which shall be the month and year of the commencement of the delinquency on the account that immediately preceded the action. The question would be whether going over the credit limit would be a default equivalent to being placed for collection, charged to profit or loss, or similar action.
