Hi all, I have a friend that needs some help. In June of this year her husband left out of state and left her with all the bills. She has been desperately trying to make her house payment, 2nd mort. payment, car payment, etc. Unfortunately, she is now 3 months behind on the house and close to that on all CC's. She has come to the realization that she is not going to be able to continue with these financial obligations. The husband is not listed on any CC's or the home but in Michigan he is responsible for 1/2 of all debt incurred during their marriage. The questions she has follow. 1) Should she file divorce before filing bankruptcy? 2) The home is not in foreclosure yet even though she is 3 months behind. Should she file bankruptcy before going into foreclosure? 3) Any other help would be greatly appreciated.
