Filed answer to summons what next

    Ok i filed an answer to my summons. Hopefully they will drop the law suit The next step is to request validation on the account, I'm a little confused on where to send this request. To the original credit card company, which is named as the plaintiff on the suit, or to the law office which filed the suit which I believe is also a collection agency.

    1. You need to become familiar with your state and local court rules. Every jurisdiction has it's own procedural rules regarding lawsuits.

    2. You will probably need to become familiar with your state discovery rules. After being sued, validation tends to become a moot point.

    (Although, it may be a good idea to demand validation the plaintiff may not be required to do so)

    You may need to use formal discovery methods to make Plaintiff to provide the evidence.

    However, the best course of action may be to sit back and do nothing along with hoping that Plaintiff can not prove it's case by establishing that you owe the debt.
